Someone would have to pop an engine, have a warranty claim denied based on an aftermarket filter, reference Ford documents and memos, and then maybe there would be a case. So far, all Ford has done is not maintain the supply chain for needed parts. No damage, no lawsuit.
There are different types of damages.

I've seen warranty suits before where the vendor changed specs and was sued due to increased costs.

Tesla can't sell you a car and then later issue a revision that says you can only run their tires (which are way more expensive) or it voids your warranty. It's a significant departure from the original agreement. Lots of case law on the matter.

But as I said, it would never see any of that. Judges and attorneys like out of court settlements and all Ford would have to do is allow an alternate and the harm is gone. Which is what would happen.

I dont see enough here to get a lawyers attention to pursue such a suit. In a months time, there will be more filters than anyone is going to know what to do with.

This particular subtopic is silly.

Buy the $90 eBay filter or wait a month. I guess there are damages..... the difference between the $90 filter and the $35 MSRP price, so about $55.

You're fixed on this whole recognized damages thing and it's just not the way contract law works. If you violate or depart from an agreement, that can be a matter of suit, whether it harmed me in the past, or will harm me in the future. You've altered the agreement without mutual consent.

But I've also dealt with a lot of big money agreements and I've been around the block long enough to know that companies often do nothing until they're compelled to act.

If the 2087 is widely available, Ford's change of spec is within the spirit of the original agreement (at the time of your purchase). Specifying (after the fact) consumables that aren't available IS HARM as it's a departure from the original agreement. Otherwise the ability for a manufacturer to change specifications (and redirect additional profits to themselves or their interested parties) would be virtually limitless.

What you're referencing is standing and I don't have to die or be injured if you've violated (or unilaterally altered) an agreement to seek that you return to its original terms.


Obviously everyone hopes you are correct and the market floods with the new filters.
