You can file now, it's past the 15 days (way past) without taking the car back. They will have the 10 days to respond & (if they elect) another attempt to repair. Since the car is sitting there, they can't say you didn't make it available when they needed it etc.Well the car has been with them for 32 days and the Florida law is 15 culmative days but it does stipulate that: After the manufacturer’s receipt of the notification, the manufacturer or its authorized service agent must have at least one opportunity to inspect or repair the vehicle.
So since it has sat there for a month I dont see what I can do about it until I get the car back and the vibration comes back right ?
I left my car (for the final time) on 5/24 & filed on 6/27 without ever setting eyes on it. After they agreed to the buyback, I went & removed my personal stuff, deleted my addy & phone from Sync etc.) on 8/5 - that was the 1st time I'd seen it since 5/24. It was still sitting in the same place when I went to get my check on 8/15.
If you do take the car back at anytime during the process & it gets damaged, it's on you ! There are 2 damage inspections - 1 when you go to sign the buyback agreement and another when the check is ready & you 'turn in' the car. Since I was not taking it, they filled out & signed both inspection forms on the 1st trip. When I went for the check all I brought was the manuals, 2nd key, title & their loaner.
