officer lied on accident report

He's not wrong since police have no accountability in the US. You don't know if you're going to get a cop that's power tripping. He could literally empty his gun into your, your dog, or your spouse and walk away with a vacation (after the good ole' boys at the union say he did nothing wrong) by claiming he "feared for his life".

While the chances of the above happening are slim, they are way too high.

If State Farm says it is finale is it really? I cussed the guy I was so mad.
I am willing to take it to court.

Oh yeah on the report it says I was in the wrong lane. BUT it says she was changing lanes. When she changed lanes it was into me.

Have you contacted their supervisor?
Did anyone get a ticket?
Court and Insurance companies operate independently.
You can appeal the insurance companies decision.

You have to look at it from their perspective. They probably get a LOT of people who claim the police report is wrong.

You're going to have to fight to get the citation and report amended before State Farm will take you seriously.

Sucks, but in many states, the police report and any citations are boss. In fact, in FL, as I understand it, it's 50/50 regardless of whether the other person admits fault if you don't secure a police report. Which really sucks because I've been rear ended 3 times now and once had to wait almost 2 hours for police to actually show up. You're stuck sitting there if you want any chance of a citation that puts fault on the other party.

For all those claiming that not volunteering anything to the police is rude/arrogant/obnoxious/you think all police are scum etc I suggest you ask your lawyer/solicitor what they recommend. Seriously. I think you'll be surprised.

Mine has told me to answer name address DoB, where I am coming from going to, provide ID and/or license and insurance as appropriate and that's it. If its a driving stop, is it my car or do I have permission to use the car. If it's a DUI stop, no I have not been drinking and do the blow test or sobriety test.

Be polite, respectful certainly not aggressive or the "I've got rights" macho bullshit.

Anything else he asks and I am to tell the officer my lawyer has instructed me not to answer any other questions but I am happy to make a statement with my lawyer present.

He has further instructed me that if the officer insists or threatens to fetch drug dogs or tells me he may have to arrest me if I do not cooperate I am to inform him I am going to call my lawyer, politely. Indicate where my phone is and my intent to get the phone. If he wont allow that shut the hell up until arrested or let go.

But the key thing is be polite, turn down the music, turn off the car if at night open windows and put on interior lights, pull over in a safe spot etc etc. Your not a douche bag, the officer is doing his job, make it easy for him to do what he NEEDS to do and you both go on about your way.

Are you seriously going to tell the cop who shows up that you will not answer their questions?

Thats what this thread is about, a traffic scenario and not a burglary where you shot an intruder. In that case I ABSOLUTELY AGREE that your only answer should be lawyer.

I find that if I dip my bullets in honey it catches plenty of bees on it's way thru the hive.
