Got Swideswiped 😔

This past week, I was driving home in terrible Atlanta traffic. I was trying to to let a pickup carrying a trailer merge in when the trailer sideswiped the whole right side of my car. Waited for the cops to show up only for them to issue me a citation for failing to yield? It makes no sense considering I was stopped and the guy had more than enough space to merge in without hitting me. Now Im going to have to get a lawyer to both fight the ticket and insurance to show it was the other guy at fault.

The damage isn’t great, but it also could have been worse. Going to have to get the door pulled out as well as my left front fender. Also have to get the whole right side of the car repainted. Still very frustrating I have to go through this after buying this car less than six months ago.

Yeah they just need to undent the door and front fender and then basically repaiont the whiole right side oif the car.

I'm sorry bud. I had a truck with a trailer smash the rear quarter panel of my mazda 3, totalled it. In my case, it was an ex-cop with no insurance so i get to pay for it for the next few years every month. If you were not moving, there's no way (in my opinion) you could be at fault, so i would definitely lawyer up and fight it (if it was me).

Lawyer will cost more than the repair, and you have a good chance to lose on the ticket and the claim. Insurance premium will go up regardless since you informed them. If your lane was ending you were to yield, if the other driver's lane was ending, they should have yielded.

I was thinking if the tow vehicle got by then he had right of way, I m not guessing with the little facts though.

OP said he was stopped to let the TOW vehicle in, that's when he lost the right of way if he had it. We don't know what the space was that OP left for the TOW, but the cop deemed it insufficient and issued the ticket. If OP stopped and gave up his right of way, then he should be on the hook. It's a bad situation when you try to be courteous and TOW hits you and gets away with it. As others say, dashcam lesson.

unless he did in fact yield and the other driver had the room and still sideswiped him may be the case.
