I think if you're caught driving without proof of insurance after an accident, you should be arrested, have your vehicle confiscated and sold for what it costs to partially (at least) pay for your damages. That sucks.
thats pretty harsh for driving without proof of insurance. Ive lost my card before when my wallet got stolen/car broken into and didn't realize until i got pulled over. driving without insurance I would agree with you though.

Well not proof of insurance but if they dont have any i agree. I dont keep any documents in my car because of thieves. Dont need them stealing info while away from home and going to my house or something. I have images of the docs and insurance app if anything happens.

You can prove you have insurance with a phone call at the crash site in the presence on a L.E.O. To your ins co. Proof isn't necessarily paper.

In CA, YES. My last 2 accidents were both the other drivers fault and they both had no insurance. I had to pay deductible out of pocket, but my insurance paid to fix the vehicles I was driving. Both instances were individuals in the country illegally, and LEO said nothing they could do but impound the car, and give them tickets (which he said they'll never pay cause they have no documentation).

Damn, that sucks! No insurance is especially shitty on his part. That means you have to go through your insurance which means your rates will increase and you'll have to pay your deductible. You can try to take him to small claims but just because you get a ruling, doesn't mean you'll get the money from the person unfortunately. A guy backed into me at a car wash a few weeks ago and I'm still working on getting my check from his insurance company for the damage. He backed into me going a few mph and damaged my front end and it was about $1100 in damage. Anyway, I wish you the best and hope it works out for you!
Insurance doesn't go up if you're hit by uninsured motorist. Got hit twice in about a 3 yr. period and no change to my insurance rate. I did however get the F out of CA.

Not to scare the OP but I had a Volvo coast into the rear of my car last summer. I was stopped waiting to turn right on a red (legal to do here in MD). She thought I went. I didn't. Collision ensued.

Damage was barely noticeable. Much less noticeable than the OPs. Ended up being about $10,250 in damage between labor, painting and parts. Granted, this was a Volvo SUV (obviously without the god damn auto-braking system!) so I think the hit was a bit higher but it literally barely left a mark which is why I was blown away with the cost of the repair. Luckily she had insurance. I'm actually going after her (insurance) for Diminished Value as well.

Anyway, good luck OP. I feel ya. It sucks. Not trying to scare you with this but just being realistic. Good news is my car is fixed and looks amazing again!

Thanks for the kind words yeah. Good to hear about no increase in our insurance rates since I wasn't at fault as that was my biggest concern. As for as collecting my deductible, hopefully it won't come to small claims court but I guess I'll see.

Sorry to hear this man, I'm a claims adjuster and CA is one of the 11 states I handle, and there are so many uninsured people in that state it's sad.

Luckally the damage is not bad, the insurance company will take him to collections if he has no insurance. U can take him to small claims for dimished value and your deductible if it's not waived but if he has no insurance he likely has no money and that will just be a giant waste of time.

Rolling up to a mustang event in a Camaro... Insult to injury. I would go back and get a different car asap. My mustang group has an 'open' policy. We let any car come tout club events and park with us. Whenever Camaro guys come, there is polite conversation, casual look at their car, and then it's like a 4th grade dance. Girls on one side, boys on the other.

I'm sorry you got into an accident. I am also glad no one was hurt. Man, you demonstrated quick thinking to be aware where you were and getting a police report.

Hopefully your insurance will not tag you for the incident. Do you know if they will go after the guy for not having insurance? Somone should. We all are paying more because these people didn't. Just my opinion.

One of the reasons I have Uninsured Motorist on my policy. Got into an accident in North Carolina on vacation, hit and run, other driver had no insurance, so they basically told us sucks to be us. Had to get a new vehicle as the old one was totaled and couldn't get anything for the totaled one.

Cali can suck eggs. A couple years ago I was the victim of an insurance scam there (woman in a beat-up '09 Corolla with a suspicious amount of multi-colored paint transfer on the car pulled out so I'd hit her at 5mph; the front of my car grazed hers). Not a damn thing I could do about it. She claimed neck injuries and the whole nine yards against my insurance company while she herself couldn't provide a valid insurance card.

I really enjoy that my insurance is higher now because of her. It's the best.

Slightly misleading. If you have collision coverage, you have the option to also purchase collision deductible waiver, which is essentially umpd, except it is not capped at the $3,500 limit like umpd. I don't understand how anyone buys a policy without CDW... it is less than $10 / 6 months.
