So those who have won and opted for another Mustang as a replacement, how does the terms work?

Do you get an exact replacement as your original?

Do you have the option of picking an upgraded car for same value as your original?

If original was financed, does the financing remain as is - meaning if you paid 6mos into the term, you're not restarting payment term over, correct?

If you had been offered extended warranties (or purchased them) on original, are these carried over to the replacement?

Is any out of pocket money required to complete the replacement?

In Tennessee it works like this
1. Your millage at first report of the issue is set to a value. Mine is 2507(miles at service)/100000*MSRP=$1027.37 for use and IMHO that is damn high for 2500 miles

2. you pick a vehicle with the same or higher MSRP and if higher you have to pay the difference. you cannot go lower than your MSRP

3. you get the "deal" letter saying what you need to pay at closing of the deal. You have two options
3a. Pay the difference out or pocket and if Ford financed the will do a swap of collateral and nothing in your loan changes

3b. have your new purchase refinanced by the dealer or your lender

4. you drop off your Lemon and sign papers for your new Mustang or whatever else you traded for.

As for extender warranty it will start over for free with the new car if it was the Ford warranty. I will let them start it over at closing and will then say I want to cancel it so there is no millage on it and they will have to refund the full amount.

How long have you been in your process - is the new vehicle going to be accepted soon?

Actually I started with car issues in September. I filed with the BBB on 12/03/2016 and should have it done next week or the week after so it has not been that bad. The BBB tries to resolve the issue 60 days from when you start the process and after approval Ford has no more than 60 to complete but they try to do it within 30. fill out this info and they will hop on it.

When I was looking at the past settlements for 2016 on Connecticut's website there was at least one where this happened. If the value of the replacement was more than the settlement amount, the dealer and buyer would split the rest of the cost 50/50. Lemon laws vary by state though not to mention the mood of the arbitrator.

Well I just dropped mine at the dealer. They replaced the short block and I got it back on 12/13. On 1/2/2016 I took it back for a knocking issue that turned out to be they left the bolts loose in the transmission cross member and today I dropped it off because they either left the exhaust downpipe loose or the Exhaust Manifold gasket blew due to incorrect installation and it literally sounded like I was running open headers. I made sure they knew to keep the damn car and I would not take it back. I even took my licence plate off and took it with me

Doesn't exactly sound like the kind of shop you'd want to have them install a new short block in your car.....

The below is quoted from California Lemon Law Group website:

When the manufacturer buys back a vehicle because of a warranty defect, the buy back consists of the following: a refund to the consumer of their down payment, all of their monthly payments, the current registration fee, any out of pocket expenses related to the defect (such as towing fees or rental car fees), and the entire loan balance is paid off in full by the manufacturer. The only deduction from the refund is for the mileage offset which is set at the mileage of the very first repair. If any aftermarket items were purchased, the manufacturers vary on what they will reimburse for. Gap Insurance, Service Contracts, alarm systems, and surface protection plans are not typically reimbursed to the consumer.

In a true lemon law buyback, the lemon vehicle’s title is “branded” so that all future purchasers know that the vehicle has had serious problems. In addition, a decal is attached to the vehicle that reads “Lemon Law Buyback.” If a dealership then sells the vehicle, the dealership is required by law to notify the buyer in writing that the vehicle is a Lemon Law Buyback with potentially serious unresolved issues. The law mandates this in order to get the defective vehicle out of the stream of commerce. In the Ford Dealership “buy back” program, the dealership is going to turn around and sell the defective vehicle to another unfortunate consumer.

How many of yall had to go throw a lemon law lawyer? Really don't want to go that route but Ford is fighting me tooth and nail. I have to bring the car to the dealership AGAIN for another CEL this afternoon.

To be honest, I hired one right out of the gate. I know the BBB process is supposedly pretty fair in CA, but I didn't have the time or energy to do it on my own.

In CA the lawyer can't/doesn't collect a penny from you, ever. If you win, he collects from ford. If you lose, he doesn't collect.

He's picky about which cases he takes, but he took mine right away. We filed in mid Oct and it looks like we're getting close, avoiding an actual trial.

It's a no risk proposition (check your states laws of course) so I figured I would just let a professional handle it from start to finish.

Honestly I am impressed with the BBB process. I submitted in December sent them my paperwork via fax and will have my replacement car (they offered to just do a buyback but I wanted another car stupid me) on Saturday this week. So about one month and a week from start to finish and no cost no meeting a lawyer and no worrying about them fighting it.
