File with your own insurance and subrogate. There is no other answer.

The other driver's insurance does not represent your interests and it is generally a worse outcome to engage with them directly. Let your insurance fight on your behalf.

Since it was a commercial vehicle that hit you I would recommend talking to a lawyer. I drove a 3/4 ton pickup for work for 14 years and the big concern at our company was accidents. Even if we got hit by someone, a lot of times they would sue our company. The company usually wants to payout and not go to court.

Most lawyers will do a free consultation.

You could still talk to one even if Hagerty deals with it.

I don't think there's anything to talk about. It was a 10 MPH incident with no injuries and they've admitted fault to me in front of the officer (who was wearing a body cam). The issue is that their insurance company is slow rolling me.

While I'm not a big fan of this tactic, I'll throw it out there for consideration. Have you considered shaming the insurance company online? You could also search Linkedin and see if any executives have profiles that you could message.

I manage a Customer Service department for my company and this tactic has been used when I refused a consumer's request. The CEO told me I know you're right but it's not worth the fight. While you're situation is a little different, you being in the right, it may be worth a try versus filing a claim with your provider.

nevada has a state insurance office that helps regulate those that insure here. you can file complaints for slow claims and get them involved. not sure that they can move it along but it does tarnish their rep in the state's eyes and too many will get an investigation.
does SC have anything like that?

I'm sure there is an equivalent, but they'll probably do nothing. If you search through my post history here, you can find what I wrote about my experience with my dealership just not doing a safety recall for the rear camera, me getting the state involved, and basically being told by both parties to go f myself. I'd kinda expect the same from an insurance board, especially in a state run by the...party this state is run by.

never hurts to try. at the very least they will have to spend manpower to respond to the state's request.

Before you go to your insurance, I would go to FB, Twitter, whatever other social media and put them on blast. Keep it succient, like you did above, but lay out the case, and state for people to not use them.

I did this when my extended warranty wouldn't provide payment after I cancelled before the term was up. I tried for three months to get paid back. I had a new motor to pay for an all. Within 30 minutes of that post on Google Reviews, I got a phone call, and to verify my CC info was correct, and got a payment a day later.

If that doesn't work, make your insurance company deal with it. Sorry you have to deal with this, and it's refreshing to hear someone get the short end of the stick, and not be bitter about in posting here. Best of luck!

I'm also in SC and had a not at fault accident with an out of state driver (NC in my case). Their insurance dragged their feet quite a bit. I filed a complaint with the SC Department of Insurance. It definitely got the insurance companies attention. YMMV

Good to know. I can try this in parallel to working with my insurance, and see where it gets me. Talking to my adjuster last night, I'll have to pay my deductible, then wait (and hope) that the subrogation team is able to recoup repair costs before I get the deductible back.

Edit: I called the claims adjuster from Southern Trust and let her know that I had filed a claim with Hagerty, but was 1) going to call her supervisor and 2) file a complaint with the SC DOI. I then left a voicemail for the supervisor. We'll see how this plays out.

Update: Just the threat to a supervisor that I'd submit a complaint got me a call back and a check approved for the full amount of the repair. Boom.

Great advice and exactly what I was going to write when I saw this thread, after 29 years in claims. I would have first contacted the trucking company's loss department to let them know I thought the insurance company was acting in bad faith and given them one day.

Great advice and exactly what I was going to write when I saw this thread, after 29 years in claims. I would have first contacted the trucking company's loss department to let them know I thought the insurance company was acting in bad faith and given them one day.
I did that within a couple weeks of the initial incident. The other insurance company was telling me that they needed the company driver's statement and that they hadn't received it. The owner of the company called me within a few minutes and was like "That's ridiculous, I gave that to them ten days ago."

So now I need to call my insurance company and tell them to put a hold on the claim, I guess.
