My brother was a cop in Round Rock, Texas and we just had this discussion last week.
I don't know the laws Commiefornia but he said sound is subjective and in all his years on patrol, he was never issued a decibel meter.

"you're honor, there is no way the officer could know what mode the completely unmodified vehicle was in and he's wasting the court's valuable time. motion to dismiss."
Isn't there a way one could pull data from the ECU and prove your innocence?

burden of proof is on a state if the state isn't a tyrant...
Not with traffic laws, and that apply to all states, you are presumed guilty of the infraction until and unless you can prove otherwise. Same in your sate of Texas

traffic ticket s are a preponderance of evidence (51% chance it was likely ) not beyond reasonable doubt which is for criminal. This makes traffic cases much harder to beat than criminal cases.

preponderance doesn't mean "you don't need any"

Virginia’s standard for Traffic Offenses is “Beyond a Reasonable Doubt”.

Civil cases are a “Preponderance of Evidence”

every state might be a little different but in some jurisdictions the burden of proof in traffic is alike to civil.

I just got a ticket for front plate but he warned me about the tint and the exhaust.
That's interesting because even in "liberal" Hawaii, they allow your tint to be up to 35% (even though lots of them are maybe 15%, really dark). As for the exhaust noise, what, the cop has a calibrated ear to the A-weighted scale? They need a sound level meter to be able to say you've exceeded the 95 dB-A level.

after posting the above link let me say I was shocked to read it. Maybe that s why we all don t always agree only because of such diverse experiences.
The problem is while some car guys/gals will show up someplace and be respectful and not cause issues, There are others that play loud music, leave trash everywhere, do donuts, block of intersections, and have a rowdy crowd that follows along to get that f/b, insta, tic toc or you tube vid, of someone showing their @$$, for likes.
So they don't pick and choose, they shut them all down.
It aint hard as these events/meets are posted online so the popo know when and where.
Car people going out to hang out together is going to have to become like the street racing of the past. Word of mouth and no posting about it on socials and kicking those that show their @$$es the door.

Here they have tested new muscle cars/sports cars and the like and know the levels of each stock.
My good Friend that is a local town officer, said they have a listing of vehicles tested and numbers laminated .
My HHP in sport at 4500-6800 is tickling the legal/ not legal limit, track is not even close.
Tested by a db certified meter

thanks for sharing I am on sport plus mode now guess gotta be careful.
Well, if you take a look at how much it is open in Sport+ nominal position, I would not expect it to be exactly "quiet" even when coasting. My feeling is that Ford made Sport+ valve nominal position to be (barely) legal, but since they could not guarantee it with Track fully open valve, they put "only on the track" warning in the manual.

Anyway I would expect Sport+ to be close to Track (considering how much is it open) in the acoustic pressure, the note is slightly different though. If you really care about the noise level, Normal or Quiet seems to be much safer.
