First thing is, don't accept the settlement offer from her insurance company until you've had your car fully inspected by a reputable body shop and given a quote to repair ALL damage. If her insurance company is being difficult you can still pursue a claim through your carrier and they will get reimbursed by hers. (minus deductible which you can claim with her carrier) They will try to offer you a settlement for "pain and suffering", they will lowball you. Don't admit fault or that you are "fine" to her insurance carrier. Tell them you are going to see a doctor and will also need a rental car because you car is not drivable in it's current condition.

Find an independent body shop. Demand OEM replacement parts only. Do not settle for anything. Get exactly what you see as fair and reasonable. If they are not working with you contact your agent for help.

A lot of good advice here especially with dealing with her insurance. Teach her a damn lesson and stick it to her insurance and rate. I detest these people. I see it all the time and it's just horrible.

Not true. That's what lawyers are for. I demanded factory parts for my wife's Passat wagon that was hit by an idiot teenager. Her company tried the non-factory route until I said the magic word - Lawyer. No problems after that.

Are non-OEM - generic cheap parts - even available for 15/16 other than aftermarket performance stuff?

Within the last couple of years the lawmakers in Pa were cracking down on this texting and driving bs. They made it a $50 fine. Whoa! That'll stop it!
It should be the same as DUI

Ended up going to the ER for back pain in my upper back between my shoulder blades, x-rays came back negative but I got referred to an Ortho just in case. Nothing excruciating but I'm not taking any chances.
Spoke to the insurance (state farm) and so far they seem pretty cool. I let them know I was having some discomfort and I would be seeking some medical attention, I also let them know my exhaust was pushed into my rear tire and that although I was able to tie strap it away from the tire bt about 1/3 inch clearance I was not comfortable driving the car so they offered to put me into a rental right away. They gave me the option to go to one of their approved shops or pick one of my choosing. I don't get into many wrecks so I have got to ask around to find a reputable shop who can get my car back to new.
Anyone have any experience with asking and getting reimbursement for diminished car vaue?

You will likely have to press the issue for the diminished value. Also for those addressing ford parts, are there really a lot of aftermarket out there? Seems like they will be needing to order ford parts simply for availability.

When I work wrecks, if the driver at fault admits or slips out that they were doing something OTHER than looking ahead and driving, i will hammer the shit out of them with as many citations and fines as possible. ZERO excuse for that bs.

I've had a few accidents in the last 5 years:

-diminished value, this is a tough one. The way it works is that the burden of proof is on you. You need to sell your car in the near future. The record of accident, however the new buyer learns of it, needs to cause a reduced selling price. THEN, YOU need to prove to the insurance company that your car would have been worth more otherwise. They will never hand you a diminished value check otherwise. Although, I do agree that after the accident we should be "made whole", you know, you didn't ask to have your vehicle damaged, and anything someone else does to affect your investment in the vehicle and not pay you back in kind is a damn shame in my opinion. Besides, if you never sell your car, are you owed "diminished value"??

-OEM parts. Yes the insurance company will try and stand firm on this one, but they can't. Unlike diminished value, they must replace and refinish your vehicle with OEM. If they balk at that, you can mention "lawyer", but you can also refuse the work until they agree to use OEM. They are obligated to make you whole.

The few times I've made a claim with Progressive they always insist on OEM parts, it's not even a point of discussion.

Might differ from state to state though.

Very sorry OP, I hope you don't have any lingering problems with your back/neck whatever. Three out of four of my accidents have been the same scenario, once by a cop(derp).
