I'm having a hard time understanding the post.

They have your down payment, and the cashiers check from the bank, correct?

They said because it's a cashiers check, they have to hold the car for 10 days after they get it?

They also said they won't hold the car during this 10 day period, of which 7 has already elapsed?
10 business days and yes they won’t hold the car

The check has cleared now why there be a reason to still hold it
If the check has cleared and you signed all of the paperwork then they legally can't hold it. It is your car. Something odd is going on.......

Yeah this makes no sense.

Go get the car. They have your money and your car.

I wonder if it is just a simple miscommunication internally between dealer employees at this point. We all now competence can very greatly between dealers and staff.

Hopefully it is something simple like this for OP and not other things on our minds.

Everything is clear, you signed the agreement and you have paid the deposit?
I don't understand why the dealer wants to give you such a hard time if it is a done deal for them.

Unless there is someone offering them more $$ for your car and can pay cash immediately...I guess?

That's absolutely stupid. The bank contacts the dealership directly to make sure all the details on the purchase is correct, and they usually mail the check directly to the dealership(I wanted it in hand myself, so I just went to the branch and they made one for me on the spot), so what would be the hold up? They can call the bank directly and verify the loan and check # is good.

They just sound like a bunch of assholes who don't know anything. They've probably fallen for the Nigerian prince scam once too many times.

Cashiers checks can bounce, that is why the dealership is waiting to make sure everything is good.

I always do wire transfer when ever I can this way I avoid any waiting period.
The whole point of a cashier's check is that it's drawn from the bank itself. I can't think of any way a cashier's check could bounce unless the bank itself wasn't solvent. Regardless, he said it's already cleared, so the situation doesn't make sense to me.

Did u sign the title paperwork etc? If so then go up there with your copy and whatever proof of payment from the bank with the sheriff.

Otherwise - ain’t your car yet.

You can forge cashiers checks, that's why they're almost worthless at this point and why anyone you give one to will wait until it clears, which usually takes 5-10 days.

Never heard of this, unless it's from some obscure little bank. I picked up my GT350 from a dealer in pennsy, handed them a bank check for the balance, signed the paperwork and drove away with the car.

When I bought my truck I gave the dealership a personal check for $25K .....the down payment and signed paperwork with their finance to get financing at my CU matching rate.

Drove off with the truck that day and a week later got notification from their chosen finance company with the loan 411. I am in So Cal also, and while some differences, I gave them a personal check....so something is up...

Did they try to return your down payment and or return bank monies ?

While that is true, Cashiers checks can and have been forged, I bought my GT350 in Indiana, Fed Exed the Wells Fargo cashiers check and sale p-work and they released the car the next morning to the transporter, probably before they got the cashiers check to the bank....so different policies/different dealers.

Something definitely up in OP's case, not looking good.

I've never heard of this either. I had Wells Fargo make me a check for half the total that I brought to the dealer, financed the rest through Ford, and drove out with my custom ordered car that day.
