I'll call my agent today, yes it was loose in the road. I had no choice but to run over it as it was bumper to bumper traffic. Running about 45 MPH so if I hit the brakes I would have cause a chain reaction wreck.
Probably need to reread my policy to be sure if the coverage declarations. I don't agree with if it is on the ground versus coming from above ground determining whether its collision or comprehensive but then why would any insurance company care what a customer thinks.

There are even colossal insurance companies that insure regular insurance companies.

Florida weather risk has made the whole system unsustainable.

Insurance is tricky to understand.

Imagine OP was on an empty 2 lane road and hit the object. I still think that would be deemed collision.

If he served to avoid said object and put his car into a ditch ... also collision.

In both cases he was driving the moving car.

You can specify the deductible amount for collision and comprehensive separately.

If a deer jumps in front of me and I hit it it is comp. I'm still driving.

If the hitch had fallen off and hit my grill or windshield it is comp, since it was on the road it is collision and dings my record as an at fault incident.

I don't think it is fair but it is what it is. I have an appt to get it on a rack tomorrow.

So, you were in bumper to bumper traffic and I am guessing the vehicle in front of you had enough ground clearance to not make contact with the hitch laying in the road, so it was not moved or otherwise impacted by the vehicle directly in front of you. Also, you had no indication or warning from vehicles in front of you swerving or reacting to avoid hitting it that could have allowed you time to react.

It really sucks that it's a ding on your record since you could not avoid hitting it, just lucky that it was not slung up in the air after you hit it and hit a vehicle behind you that could have caused an accident that would be also deemed your fault.

Just can't win for losing in today's world.

Just can't win for losing in today's world
But VDoT did pay me the $1400 to replace the RR shock and alignment after I hit a trench left by a road crew. Talk about gov't "efficiency". First DoT had to confirm site, then pass it on to the General Contractor to look into, who then passed it onto the sub-contractor who was the one digging the hole. Took a little less than a month. Still, why does the consumer have to deal with multiple fingers in the pie and chase the bouncing ball? How about pay me from VA Treasury and then you bureaucrats can play pin-it-on-the-sub footsie at your leisure.

That is exactly what happened. I had about 3 car lengths between me and the car I was following but had cars on both sides and the A hole behind me was on my bumper. I try to keep a safety cushion but it is not always possible. If it did fly up and hit the car behind me I did not see it ans saw no reaction from that car that would make me believe it did. I'm starting to rethink the lowered car thing.

I'm not going to turn it into insurance unless the bill for repairs is over 5K which I doubt it will be. I did notice today one of my exhaust tips is further away from the bumper then the other. Maybe I got lucky and it only hit the pipe.

Isn’t it nice….They found a way to make everyone pay for insurance they can’t really use. I love our country, but this is another thing that needs to be fixed.
Guess its tooo late but I'd tell now bbut if tell them it came out of pickup truk bed

I got lucky. We saw where it hit the cross-member, just scraped it no dents, then it hit the flex joint in the exhaust pipe also hit the pipe where it turns by the rear diff. No leaks. Should be an easy fix. Might be the excuse I need to install my cat delets.

If it had hit my grill or hood or windshield this would have worked. But because it damaged under the car the object hit the road and at that point became collision.

I argued a bit but ultimately it is the lawyers in the company that call the shots.

I suppose I could have hit my grill with a sledge hammer and then said it fell off the truck, flew through the air, hit my grill then I ran it over. This might have passed the Comprehensive test. :cwl: :crackup:
