I've never been in situation like this. Can't they just write it off as a loss and get you a new car? Even if the repairs are good it will never be 100%. I see it's a 50th and may have sentimental value but if it were me I'd rather have a new car. You can always get take off wheels etc.
Id love a new car. But to be totaled it has to be a certain percent of damage. I heard anywhere from 70 percent or more of the cars value has to be damaged to be totaled. I aint anywhere near there.

Id love a new car. But to be totaled it has to be a certain percent of damage. I heard anywhere from 70 percent or more of the cars value has to be damaged to be totaled. I aint anywhere near there.
That's rough man. I would be concerned about the unibody/frame. Hope it works out!

You do understand, of course, that the paying insurance company is likely to lowball you. You can fight their offers.

TBH I honestly believe you'd be best off in a new car. You can cite depreciation, and you can also push for a full electrical examination; it's unknown what sensors that impact damaged, but 3 or 4 years down the road when sh*t starts to malfunction it'll likely be because of jarred/damaged wiring/sensors.

The instant you mention anything regarding health issues the other company will be more likely to play ball. The last thing they want is a long drawn out medical case, something a helluva lot more expensive than a few thousand in diminished value.

The majority of the money that auto insurance companies have to pay out is for medical expenses not fixing some fenders. So when you start to *threaten* with medical bills then they tend to listen.

The instant you mention anything regarding health issues the other company will be more likely to play ball. The last thing they want is a long drawn out medical case, something a helluva lot more expensive than a few thousand in diminished value.

The majority of the money that auto insurance companies have to pay out is for medical expenses not fixing some fenders. So when you start to *threaten* with medical bills then they tend to listen.
And that is why I go directly to the other persons insurance company! It is not uncommon for aches and pains to appear a day or two after.....

I'm going through a DV claim here in VA atm. The person who did my report is very well known here and he sent the Insurance a 6 page report and a $12,000 estimate for my DV. Thing is, the insurance can lowball me all they want, but if I plan to take it to court I'm 99% sure I'll win immediately because the driver that hit me was texting. My lawyer said I shouldn't even worry about it.

In regards to your vehicle, man that hurts me... Hope everything is okay. Go after their insurance, and see what they offer you, don't threaten them directly that you'll go to court but let them be aware that because their insured driver's negligence your car is damaged and you are rightfully owed DV. Not to mention its a 50th anniversary. The accident could've been avoided, and with the other driver being issued a citation, there are many ways you can use that to your advantage in court. My total damages were about $8,000.00 btw, seeing as your damages are more than $10,000.00 I would assume you're owed quite a bit. Do some research, and I say fight for it. I know I would.

Hire a lawyer. Sue the driver, not the insurance company. SHE is the one responsible, and SHE is one who has to make you whole because SHE is the one who caused the accident. Most folks forget that the responsibility is the driver's. Insurance companies are secondary parties to the incident.

Thanks Kev, i am pursuing this as we speak. Massachusetts doesnt recognize DV, so my insurance co. is off the hook. I need to go after the responsible party. Kev, how much did your damage amount to? Must be significant for a 12000 DV.
There is a guy on line that charges 225.00 to do a DV valuation for owners seeking this info. Did u do something similar to get your report?

Get the rear suspension looked at, and make insurance pay for a rear wheel alignment.

I get so fired up when i see people texting and driving. It is not just teens. One lady followed me on a state highway for 5 miles, phone in her hand on her wheel texting on a 2 lane a 60 mph following me in traffic.

When we got to a light, I got out and politely asked her to not text and drive, and she gave me the big old FU and drove around me.

It is to the point where I hate driving some times because i trust no one.
Metoo man. I got rear ended in my 14 GT by a guy texting last year and ever since then I'm beyond paranoid. I get texting at a light, but people have gotten out of control. Every morning/afternoon commute I feel like I'm playing frogger to stay away from oblivious drivers.

You can consider yourself somewhat lucking in that you have someone to go after for DV. I took deer hit which caused sidebag deployment on my 2013 Charger. Based on my experience with trying to sell it then eventually trading-in when my '16 came in I figure I lost at least 20% of the value.

You may LOL, but there is an aspect to your (not your car's) body's repairs. In an insurance fight, they may look into your history for what led to all your "rebuilds". They may try to associate your pain with those; IOW that maybe you feel pain all day everyday in spite of this accident. And so on.
