That sucks Matt. I would definitely seek DV again if car is not deemed a total loss.
I don't think you can recover diminished value from your own policy unless it explicitly covers it. But if the tree or its owner has insurance you might get diminished value from that policy.

Ah, interesting point. Last time I did get it from the other person's policy. I'll have to read my policy and see if it's stated.

That really sucks let me know the name of your insurance provider and what they decide to do. I would suggest removing the interior panels on the right rear yourself and document how bad that dent really is. What may happen is they estimate it for only the sheet metal and then by the time they cut the old away and find out the structure is bent they'll say they have put too much money into the fix to total it. There are laws in every state that set the limit on the max estimates to repair damage before it's mandatory to consider it totaled - usually 75% of the fair resale value. I have seen more than once insurance companies and repair shops estimates seemed to blatantly ignore signs of more severe damage, then they come back and say exactly that "if we'd have known the damage was this severe we'd have totaled it, however we already have put x dollars into the repair and will not total it".

For example my ex-wife rear ended someone in our mini-van, it was clear there was coolant under the vehicle. However the insurance company adjuster made the assumption they radiator was leaking and the source of the coolant, however the radiator was fine the block had been punctured however. They ended up paying $17k to fix a van with a resale of $18k, however saved themselves $1k in the process. Though I did get a rebuilt engine when the van had about 100k on it so, perhaps I came out ahead there...

Good thing no body got injured. However that is really bad luck to have 2 serious incidents in one year. Similar thing happen to my first 2015 Mustang. I had it for little over a year and I got rear ended twice and then the dealership totaled it. I guess third time is the charm. I didn't consider myself a superstitious person but after owning that car I am now. My advice to you is start looking for your next car.

I think most policies explicitly prohibit any diminished value compensation for your own car (I know my State Farm policy does).

Yeah it looks like my policy does too. But I did get diminished value last time from the other person's policy, even though theirs probably said the same thing. I know in my legal letter it notified my insurance company that I would not be considered "made whole" until I was compensated for the loss in value. The "Made Whole Doctrine" is what I believe they cited. I'll have to get in touch with them again if they decide not to total my car.

So far his initial estimate is $10,100 on my car. Seems pretty far away from total on a 2016 GT Premium with ~12k miles. But they're still working on it and will give me a decision soon.

To total the GT with your options, you are looking at about 21k worth of damage, or a lazy estimator that looking to get in and get out.

Either way, it'll be a loss of time and money when insurance is involve, but since you are a youtuber, it might be a good way to boost your views and subscriber counts by taking them car shopping.

Seems like you like to keep the car stock instead of modifying it, might as well get something that's track ready, like the GT350R, ZL1, viper acr or gt3rs and enjoy the factory warranty (bumper to bumperrrrrr)?

The reason the other party had to pay diminished value is that YOU did not have any prior agreement with them saying they wouldn't owe you for diminished value. Unfortunately, you do have that agreement with your insurance company regarding diminished value to your car.

When a 3rd party damages you and is declared 100% at fault, they are liable for your losses, period. Their insurance has to pay up to the value of their policy and if that's not enough, they owe you the rest out of their pocket.

Well I never track my cars (not covered under insurance and track day insurance is pricey), and am far away from being able to afford any of the cars you mentioned. Maybe someday haha.

Yeah. Getting it the first time immunized you somewhat. That MC sideswipe is probably about as bad for the car's value as this will be so you could only lose the difference in diminished value.

Good luck. Hope they total it if that's what you want. I'm not superstitious either but I wouldn't mind being forced to buy another car after two very unlikely types of damage. That car is sure to get hit by a meteor soon.

Damn Matt, just saw your video. Glad your okay. Hope it all works out and you either get it repaired back to "new" or you can wait to find out if they will be making that '18 Bullitt. Scott (Mustang Lifestyle) just lost his car last week due to an accident. Just saw his video test driving a used GT350.

Scott (Mustang Lifestyle) just lost his car last week due to an accident.
That one looked like a self induced "accident" since no real details were ever given. Obviously the car slide into a curb going sideways and then hit something solid. Both of Matt's accidents were totally out of his control.
