Lets not forget the Magnuson-Moss Act.

The dealer will have to prove a "tune" caused a failure. My dealer has flat out told me, pop a piston, they may look into the flash file , but general failures, no.
With engine failure or drivetrain a ECU that has been tuned from outside source other than Ford is all they need to deny. Power window failure well that is another story.

That act won't save you. And the dealer doesn't have to prove anything. They'll just flat out refuse to fix your car and now the burden will be on you.
Correct. Guys talk about getting a lawyer but in the end lawyers are not cheap either so many many times the consumer loses. :)

Buy a back up pcm out of a wrecked car that hadn't been tuned in case of engine problems

Well they gotta prove that your tune was actually the cause of the problem. I've tuned my car already and gives better MPG as well as better response, heck I'm even thinking of doing a gear swap.

The above video just clouds the waters, it is not a cut and dry case for either argument.

Buddy of mine had his throw out bearing on his 15' PP explode and wipeout the clutch disc. He is tuned, has exhaust ect and had zero issue getting his car fixed under warranty.

It all depends on your dealer, some are cool and some aren't. The point is the Magnuson-Moss act gives you no leverage if they decide the aftermarket tune caused the issue and they will not cover it. The burden is still on you to take it to court and prove the tune had nothing to do with the failure.

Even if I'm using ford products? Think ford products will still be under warranty, as long as the dealer installs not 100% sure on that part though.

Depends on the dealership. The guy who runs the service department at mine drives a heavily modified, supercharged Mustang, and most of the guys who work for him drive cars that have been modified somehow. They're all car guys and gearheads, and they cover any aftermarket warranty issues so long as they're the ones who install the parts. A few times Ford has refused to cover various issues on my old modified cars, but the dealership covered it for me anyway.

Depends on the dealership and your relationship with them.

Lol dealers could give a rat's ass about Magnuson Moss. If they deny your warranty claim the problem is on you now and you know damn well bringing up magnus whoever ain't gonna do jack but have them laugh in your face

the info is murky on this topic. If you flash it back to stock before visiting the dealership for anything, including an oil change, you should be fine for most warranty repair, aside from major engine failure. I don't think they will check flash counters if the engine has a minor failure, such as oil leak.

But if has a major failure, its most likely on you. Engine failure is more much more likely if there is any pre-ignition / detonation, and you are more prone to those higher up on the power curve. So you will have to trust the tune and the data logging to make sure that never happens.

Once a dealership discovers a tune, they will probably type that into the computer and then your car is marked across all the dealerships.
