2017 GT350 now gone to a great home.
Here in Chicago where there is never more than two feet between cars and jack holes like that will pull the super merge and you need to stand on the brakes then go about your business. Seriously, it’s an absolute accident waiting to happen every 30 seconds. This video of yours looks like you are out in an abandoned cow town.

At the time of impact he was going straight in the same direction. He didn’t brake unexpectedly. So, yes I’d say it’s correct.

The video shown here to a judge would be a failure to yield on their part. That said, a judge here in small claims would also most likely put part of the blame on you as well. The accelleration rate from the light is what would most likely get you a little of that blame. Also, the idea that some will state if anyone rear ends someone their at fault is the exact reason all my vehicles have dash cams, especially my service vehicles that with trailers at most times have a gvw in the 35k range. People do dumb …. like that all the time. If you end up in small claims make sure you file on the other driver, the owner of the car(if its not the driver) and their insurance. And if you have uninsured motorist(which you should)l your insurance as well. It’s their job(your insurance) to step in here on your behalf.

Looks like you had plenty of time to slow to avoid hitting him. Yea, they’re wrong for pulling out, but you could have made a better attempt of avoiding the collision.

He barely got straight before contact was made. It looked as if he was going to yeild and waited until I got close to pull out.

I would say it would be a tough call. Could go either way, depending on how your state and local municipality usually handles this kind of situation.

No. It's basically irrelevant, especially if police doesn't care. There is no criminal case here where this would matter and there is no "justice" here to be found because someone misrepresented what he was doing.

Regardless of whether he failed to yield on a right on red or simply merged into your lane while cruising down the highway with minimal space to perform that operation, you still used poor judgment in accident avoidance. I cannot imagine you not being cited as contributing to the accident. Sometimes you just need to let this s hit go. This is one of those times. Racking up attorney fees for what?

I asked but didn't see him say if he was cited or the disposition. If he was cited or "convicted", that would probably matter in any small claims (or other civil) court.

I don't understand paying a lawyer either unless his damages are more than seems likely based on the video.

I'm thinking there is more to this than said so far.

Ky is a no fault state so it doesn't matter. Although he should be cited for failure to obey a traffic control device.

You should have slowed and not hit him. Defensive driving 101.
