Next week will be the thirty days for my car out of service. I do not want a replacement. I just want to rid myself of that dysfunctional mechanical bastard. So do I go at a buy back on my own, or turn this over to the attorneys? In PA there is lemon law with no cost to the consumer. I'm thinking attorney, what do you think? Replies are appreciated.

i would attempt with out them. they shouldnt be needed. but if they give you push back then i you could seek help

That's what I wrote to another member since he was getting resistance. And that prompted me to ask. Maybe some members that have gone through the buy back would do attorney if they had to do it again.

I am finishing up the buy-back process through Ford. It's sucks. Gotta be patient and be available on their time. But in the end I don't know if lawyering up would yeild any better/faster results.

Well Ben I think you just helped me out with this decision. The final deal will be the same no matter who does it and I don't care about how fast it happens. Just as long the time frame is reasonable. And I make my time available to my customers first, Ford is not at the top of that list.

Each State has a Lemon Law and those Laws are designed to protect the Consumer which the consumer has these options:

1) He/She can take the issue head on, by themselves. It the Consumer has facts such as any correspondence between them and Ford, them and Dealership or them and BBB Autoline, Dealership work orders, repair orders, etc., they will be just as successful as an individual who was “lawyered up”. Facts are all that is needed.

2) If the Consumer is not reliant upon themselves or feels he/she can’t be successful going up against Ford for a Buy Back (vehicle replacement or refund), then they can opt to “lawyer up”. Be aware that lawyering up can result in fees (Attorney consultations and labor hours for taking on cases vary) AND you’re relying on an Attorney’s Office to work your case. This means you are in line with every case before yours, you will be locked into the Attorney”s time frame and how fast (or slow) they operate trying to get results for you in between all other pending cases.

Lawyering up is not always efficient and does NOT guarantee a “win”.

I went through the Buy Back (vehicle replacment) process and did everything myself, no Attorney and came out on top - others have done the same. Again, if you have facts AND the problems with your vehicle falls within your State Lemon Law stipulations and guidelines, you will have a solid case and most likely will come out on top.

As I have noted before - any person thinking of requesting a Buy Back must know that they HAVE to let Ford attempt the warranty repair effort and not just once... some Lemon Laws have stipulations where the Vehicle Owner has to have given the Manufacturer at least (3) attempts at a Warranty repair for the same issue. If the 3rd repair effort did not result in a satisfactory repair to the Consumer, then the vehicle may qualify for a Lemon claim.

You can’t just claim a Lemon claim if Ford has not been given the chance to try and fix the problem.

Now some warranty claims have resulted in the vehicle being at the Dealership for an excessive time period - which leads into State Lemon Laws where if a vehicle has been down for:
1) 30 consecutive days
2) 30 calendar days within a year
3) 15 consecutive days (some States have less time than 30 day rule)

Then the vehicle would automatically qualify for a Lemon claim, even regardless of Warranty repair attempts.

There’s a lot of variances in the individual State Lemon Laws, that’s why I always recommend members to thoroughly read through and understand their home State Lemon Laws.

It’s honestly not difficult to do a Buy Back on your own, an Attorney is not required. It is tedious, the vehicle Owner must be persistent, must be proactive with follow ups and it can take some time from start to finish - but in the end, you’re getting out from under a problematic vehicle.

Some S550 owners who have gone through the Buy Back have had turn around times from 2-3 weeks, to 4-8 weeks all depending on their initial claim, how fast the Buy Back was approved through Ford to Ford RAV and how fast the paperwork process moved along.

I was back and forth with this decision. I started the process on my own. Attorney is a back up plan.

I've read 8+ pages in this forum on the 18/19 issues trying to make a decision on a car (walked away), seems like it was a headache, but doable without a lawyer.
