A tune won't cause oil pump gears to break.
Given a tune can change dozens of engine parameters including the redline, that doesn't seem like the best example (though I agree about the MMWA in the context of causation / correlation).

I don't have a dog in this hunt, and I'm not going to comment on its ethics, but are we going to ignore the Magnuson-Moss Warranty Act? A carmaker has to be able to prove that a modification has directly caused the damage exhibited. A tune won't cause oil pump gears to break. A tune won't cause engines to rattle their oil filters loose.
It is an ethical question, and to each their own. HOWEVER, I do know several people that have been denied waranty work, legitimate waarranty work, because of modifications that have 0 do to with the issues. an airfilter does not cause leaky injectors, or overwork fuel pumps. a tune does not reslt in cracked subframes ect ect. yes, there are people that abuse the system and smoke a motor on 25psi and revert to stock and bring it in.. such is life.. Show me a person that claims to have never abused a system, and il show you a person that justified their own standards in thier own head
