Hey Kyle,
Sorry to hear about your car & frustration. A couple of thoughts:
1) Dealer should be expected to take reasonable care of your car. If you have birdshit eating though the clearcoat/paint, can you use the video you took to show negligence ?
2) Much confusion around extended warranty on these GT350s. Today my dealer told me that VINS have been opened up for extended warranties and he's gonna be checking for me. Earlier this year we ran the numbers only to find out it wasn't eligible. Check w your dealer or other Ford rep and don't go unreliable info.

Sounds like a good plan to put the car stuff on the back burner for a bit!

What about a 30 day rule? Does that exist under Texas Lemon Law???? You can go that route! Google it and have ammunition and call back and demand a buyback.

If they did he still wouldn't get his ADM back... I'd seriously recommend just seeing how the engine swap goes and keep driving it.

Maybe ask them how their going to reconcile the SN on the engine vs the chassis. Wouldn't come up on a trade in but if you keep the car for generations it may come up down the road.

According to: http://www.txdmv.gov/motorists/consumer-protection/lemon-law

If your new vehicle has been out of service for repair due to a defect that substantially impairs the use or market value of the vehicle due to defects covered by the warranty for a total of 30 or more days during the first 24 months or 24,000 miles, and there were at least two repair attempts during the first 12 months or 12000 miles, and the problem still exists. If no loaner vehicle was provided to you by the dealer during this time period, you pass the test.
Unfortunately I don't qualify anywhere NEAR those conditions, or maybe fortunately is a better word. I can't even imagine going through this a 2nd time within the first year of ownership and having the 3rd engine break too!

I am glad I did not pay a huge ADM; I paid $1500~. Still, it's money not well spent. I haven't been told directly, but apparently the replacement engines come with no engraving, so it's just blank. I expect to list the car for sale as soon as I get it home, and not put any miles on it other than for serious buyer test drives. I'll sell it as having a brand new engine, see how well that goes. I may just trade it in and move on.

I wish Ford would just give me a reasonable amount for it so I don't have to deal with this for another couple months.

If the decision is made to buy back a new unit under lemmon laws you get back 100% of what you had paid(adm or not).....including taxes,fees and Interest you had paid up to that point on your loan if the car was financed ..all your maintenance cost paid (with receipts ) and any ford acc. parts added to car...then there is a $ deduction per miles used(lets say $1.00 a mile)
....ask me how i know? ;)

Thanks David, that's good to know. I'm still trying what I can with Ford.

I'd much rather be looking forward to enjoying a road trip to FL this weekend in my fully functioning GT350 that I could rely on. To enjoy hanging out with old (car) friends before my wedding next weekend. This whole thing sucks.

Update

My replacement engine was shipped out earlier this week. I'm told the "quick" response time has nothing to do with me contacting Ford customer service, as the order was processed before they ever got involved in my case. I will point out that everyone I've talked to, with Ford, or the servicing dealership, has given me a different answer regarding the engine. This update however is the latest info I've been given, despite my service advisor telling me just yesterday that he was given an ETA of 10/28 that my engine would be shipped by. I guess in a way, his "by 10/28" ETA is valid.

The engine swap is supposed to be performed next week and will take a couple days from start to finish. I can only assume I'll be called, while out of town for my wedding, to be told my car is complete. Looking forward to that :mad:.

As someone from the inside, I can tell you that they can do what they refer to as a PACO. They then take the PACO to the service manager who logs in to your case with Ford (even if you started it after the part was ordered), updates the case with current parts expectations, and then Ford does their magic to make it quicker or whatever. But the PACO can not be logged with Ford warranty/customer service without a case, and you can't PACO a part (in this case the motor) without ordering it first and waiting a day.

So in your case Kyle, they ordered the part, you opened the case, they PACO'd it, and Ford went whoops whoa no when they saw 10/28. CS Managers will call their facility's and make magic happen. Can't tell you how many times I had stuff like that happen. So without your case, they wouldn't have been able to do much unless they opened a case on your behalf which i've never seen go well. Ford ignored most anything I requested but if you get on the phone they will bend over and take it up the rear for you if they want too.
