If a person has a remote tune base file that Was never used. Is it legal for them to give/sell that file to someone else?

Dude theres no such thing as a "legal" tune. Its parameters. You can do what ever the hell you want with it if its not "locked" or encrypted. All of these guys are flashing stock ecus, You can not copyright parameters. Believe me, COBB tried with the subaru community. Its yours to do whatever the hell you want with it. And if ANY Vendor tells you other wise they are 100 percent full of shit. You cant copyright a tune.

I guess what I'm asking is if a person would be able to use that base tune and work with the tuner that sent the base tune to a different customer I.E if Someone bought a base tune from BAMA, didn't use it but sold the programer and a remote tune base file to someone. Could that person then flash their car with that tune, do the required data log and send it back to BAMA for follow on tuning?

No its all vin based. Youde have to reach out to bama directly and ask them. You can sell the tuner but the map should only be good for the one VIN
