Don't take this as Legal advice.Don't get me wrong, I love this car. I think it's well put together and certainly great value.
However my experience with Ford has been nothing but piss poor. They're even telling me whatever I was promised on signing isn't final because apparently the salesman that I spoke to is not with them. How does this make ANY sense? I have everything printed in writing on my contract.
So basically, if I start a dealership. Hire a sales guy, get him to collect deposits from 10 people and make all the promises in the world... THEN fire him. All those promises (IN WRITING) are now void? Horse shit.
I think because of the demand surrounding this release, they have become arrogant and rude and think everyone is going to on Ford's shoes kissing up to them and be treated poorly. Never had this kind of shitty after service ANYWHERE, including luxury brands! This is FORD ffs...
But yes this is enforceable as the salesman was acting as an agent for the company at the time of the sale, so yes they are accountable for the actions of this ex-salesman. The leading case for this is Hely-Hutchinson v Brayhead Ltd.
Nothing annoys me more than people who think they know the law and try to exploit people due to their skewed understanding.
Ford has our deposits and is currently earning interest on that amount so they haven't lost out, yes they might only be getting a nominal amount of interest but it is still more than what we are getting by putting the deposit down (Amounting to $25-35 per $1000 deposit per customer per year).
The service is very poor and disappointing, I am lucky that I have a good dealer and the salesman actually purchased a EB Mustang as well. He is waiting until February to receive his car like myself. He is always happy for a chat and has joined this forum as well.
