Forgive me if this is the wrong forum in advance. I was just hit by a female who ran a stop sign. She was cited by the police, so i am not at fault. No fault is a huge issue in Massachusetts, insurance surcharge, etc. She wiped out the driver side of my car, causing an estimate of just over 10 thousand in damage. My question is diminished value. Mass does not recognize DV. Meaning my insurance company is not liable for any DV. Once this major accident shows up on a Carfax, my pristine 2015 50th anniversary edition is less desirable to a potential buyer, hence diminished value. Has anyone had any success in the past in obtaining this difference from insurance? I understand i COULD go after the faulty drivers insurance. Any thoughts?

Thanks guys, you can imagine the pain i am going through.

Also, you dont see the tire and rim damage to rear. Also the passenger rear wheel is damaged from being pushed into a curb. Getting two new rims and one tire.

When i approached her right after the impact, she said ( in my best Asian accent) " I so sorry, i so sorry Baby crying in back seat". BULL...she was FLYING thru that light! If i have a baby crying, if anything, im slowing down to take a peek to check on the baby. Not flying thru a stop.

I get so fired up when i see people texting and driving. It is not just teens. One lady followed me on a state highway for 5 miles, phone in her hand on her wheel texting on a 2 lane a 60 mph following me in traffic.

When we got to a light, I got out and politely asked her to not text and drive, and she gave me the big old FU and drove around me.

It is to the point where I hate driving some times because i trust no one.

You are having pain, go to the hospital.
Pain from my 2013 heart attack with double bypass or pain from the spinal fusion with screws and rods in my back? Or both? LOL

i too get really mad when i see someone, anyone, young and old texting away while driving. I wish they drove with their windows down so i could reach in and grab the phone and toss it into traffic.

I have been in a couple accidents and my daughter in several. NONE of the accidents were we at fault and the other person has always been at full fault. That being said, I have NEVER used my own insurance to repair/replace our vehicles. I have always gone directly after the responsible parties insurance company. The less my company is involved, the less reasons they have to raise rates, or cancel. I've always been satisfied with the outcome. I say go after her insurance anyway.....

Just got an updated estimate from Liberty Mutual's appraiser. Just over 10 thousand. Basically ten grand for door, panel, interior door panel, 2 rims ( Liberty Mutual appraisal say 889 per rim! I see them on line for under 7.) But im not paying so who cares. 2-3 weeks turnaround time depending on parts arrival. Uugh. I still got my 10 Mustang, but it aint the same.

10k seems low. With a side impact I'd be worried about airbags, sensors, frame rails, K-member, halfshafts, and front suspension components if the impact was hard enough to damage the wheels.

Basically I'd be looking for them to buy the car at MSRP.

I've never been in situation like this. Can't they just write it off as a loss and get you a new car? Even if the repairs are good it will never be 100%. I see it's a 50th and may have sentimental value but if it were me I'd rather have a new car. You can always get take off wheels etc.

A couple of items are pending opening up and seeing what is behind the obvious physical damage. What has been written up is the visual. Dont know about the frame until they take the door off and front bumper area. Those areas are written up by LM as " remove and inspect". So could be more.
