Aside from that though, I'm pretty much SOL.
It really all depends. If he says "I looked away for a moment and then we hit" or "I was probably going 35mph through the parking lot", etc. Something stupid to incriminate himself then it'll play to your favor. I suggest contacting your insurance company ASAP and have them call the guy for his recorded statement before he talks to people and gets advice on his end for how to handle it. If all he says is "I was driving down the isle at a low speed and he backed into me", you'll more than likely be screwed.

You do have the witnesses but that is always hit or miss. Lucky for you it was for the business owner and you don't know them so if they do reach out and the business owner corroborates that the other party was driving way too fast in the parking lot, that'll help your case a lot too.

If you think you're guilty and the kid didn't get your plates/ID. Then repair the damage yourself and lay low or scare him and make a deal

Yeah. You won't be able to prove anything after the fact. Won't really help you. You can try and contact the other party and see if you can come to an agreement about not getting insurance involved.

Dude, this isn't even remotely true. Someone doing 100mph in a parking lot and hitting you while you are backing out with certainly be at fault and most likely leave in handcuffs to boot. In my previous posts I have agreed that if you are the one backing out, or if you rear-end someone, you will most likely be found at fault, but in the example you provided, that is just completely false. Please don't spread misinformation.

Hey OP, do you have BLIS? That is what gives you the cross traffic alert and doesn't effect the look of the car. The visible circles on the back bumper are just backup sensors and only work under 3 MPH. They also have a very limited range of just a few feet.
2 completely different systems.

Does OP have the BLIS / rear cross traffic ? Rear cross traffic is supposed to be a solution to this problem. It's expensive though as car makers want to sell you Premium to get this.

I've got a lawyer involved now as this looks like it's going to get messy. Will update this thread when I have more info.

Yeah, there are a lot of false alarms in our Explorer. Though there are few false negatives. In other words, while it alarms fairly often for no apparent reason, it is very rare for it to fail to alarm when a car is coming. So I would say that I give it only a fair rating
I've found that in instances like the one shown in the graphic in this article, the backup camera is able to see the car coming due to the angle of your car and the wide field of view. Also, if you backup up slowly, you can get just the back of the car past the adjacent car and then the system is no longer blocked, but your car isn't "in the way" yet. The point of these systems is that they can "see" a car before you have backed up far enough for you to see the car.

But it's all rather moot for the OP since he doesn't even have the system at all.
