Just FYI...something similar happened to my friend at a traffic light recently. Car in front of him stopped way past the white line....driver backs up a little and leaves the car in reverse. My friend could not see his reverse lights since he got really close when he backed up. Light turns green and the guy hits him. My friend called the cops to get everything documented...the guy admitted his fault in front of the cops, but they didn't draft a report because the damage was minor. The guy then changed his story and told his insurance company that my friend rear ended him. His insurance company won't talk to the cop. My friend now has to get this fixed on his own and go through small claims court (the cop will get a subpoena).
WTF the cop do then? What's the point?

I wouldn;t have left UNTIL I had something in writing from the Cop.

Most municipalities do not do a formal report for crashes occurring on private property. At the very least an officer should have come out and completed an exchange of information form providing each of you with a copy of insurance information and drivers license info as well as an incident number that list a date time and location of occurrence. Without some form of police report there is nothing preventing the van driver from telling his insurance company that you rear ended him.

Cops not taking a report isn't an issue. Most departments don't take reports in private party for collisions because vehicle code mostly doesn't apply there. So unless there's a crime involved hit and run, dui, etc, there'll be no report.

Now onto the damage. As long as the guy is cool and admits fault to his ins co, you're golden. If he changes his mind and says you rear ended him, unless you have an independent witness, you're screwed. Unless you have him on the vid admitting fault. Otherwise his side will claim 50/50 and you'll both be 50/50 with the dmv for the crash if filed with them.

Good luck bud. Id call his insurance in a day or so. That'd be enough time to have the other guy file. If he hasn't, Id explain what happened to your ins co and file with them. That'd be the quickest and let them haggle it out with his ins co.

That sucks man. Though I think you are in a pretty good spot insurance wise.

I had a similar thing happen to me at a car wash when i had my mazdaspeed 3. Guy in front of me just decided he didn't want to wash his car anymore, backed right into me. I was trying to sell the car at the time.... Thankfully it was slow enough (and he stopped due to my horn) that there was just a little scuff that I managed to get out.

Staring at my dash camera sitting in a box on my desk - starting to think I should install this sucker now instead of waiting for it to warm up.

First step is to report it to your insurance company, they will coordinate on getting estimates and contacting the other guy's insurer. Provide all of your videos and any other info you have. As long as your company determines you were not at fault, the other company will pay both your repair and your deductible.

You would still wait until the world's end... Police wouldn't come to a minor accident and not in a parking area if no one is injured. :gossip:

Right now I'm just in shock. Hard to register this bullshit so early into ownership, especially when I'm not at fault.

Asking for advice: I tried calling.....
Dafuq do I do now? FL is a no-fault state. Does that mean I have to bite the bullet and go through my own insurance? Also, I don't want any of this shit repaired. I want it all replaced with new parts. The car is new for christ's sake.

Call your insurance ASAP! They have mostly a shop what makes the best evaluation on the repairs for you.

I know that for sure. A) My wife had a lady drive in her car. Other party insurance stated less than $1,000 damage. Our insurance shop stated $5,000 to $7,000 and ended up with $6,800 plus tax on labour and parts. B) One lady said in November last year that our son "scratched" her door with his bumper and asking us for $500 cash. I asked for an estimation. 14 days later we got the 2 estimations. 1.) $6,900 2.) $5,000! (printed on the same paper!) Value of the car: $1,150. Something was really smelly. Called my insurance to investigate. Got a call 3 weeks later. Everything was fine! There was a misunderstanding. No claim made. BTW. That was also at a parking lot. I asked junior to watch if he sees that car again and call the police right away. Looks like they are trying to scam money from people because they know that no cop would show up on a parking lot.
