MaybeAre you ok? It looks like someones head hit the windshield? Car is definitely a write off, but a lot of if can be sold for parts.

You might be right. It may not be a total depending on how they value,pp premium eco depending on options is well over 30 closer to 40 .I have seen a new Jeep Liberty that looked a lot worse than this after a very similar accident get fixed. $14K repair of a $24K car. Given the Mustang is a $30K car (EB) it's very possible this is not a total. Though if it were mine I'd be wishing for the write-off.

Yah I was going to say something like this but there are exceptions...I mean if he is going the speed limit and the car in front of him was not visible and was going at a rate of speed unacceptable for the road with no lights, then he might have a case. But the problem is you have to have the proof or witnesses to back you up.It's that way in many states too. Even when not clear cut case where no witnesses it's all he said she said, going to come down to the fact that one car hit another regardless of circumstances. Contributory negligence with witnesses/confession/black box data, but that doesn't necessarily absolve other driver.
