Yes, been there done it (2016 to a 2018).

I’ve posted TONS of factual info regarding the process in full as well as helpful Lemon Law info that has helped quite a few folks on this site.

Ford Customer Experience (CSR level and RAV level):
Frustrating, tedious and prolonged. Doesn’t matter if you are dealing with a regular Ford CSR initially or eventually the RAV Rep. In some instances you may need to involve a RAV Supervisor. The RAV process is not always customer friendly... some have had a Buy Back completed within 2-6 weeks, others it has literally taken months - however each and every situation is different based on the Case. Also to note not all Ford CSR or RAV Reps are ignorant - some have good personalities and know their shit, some are as dull as a bowling ball.

You have to stand your ground, be persistent and proactive. Don’t expect them to continually update or call you about your concerns or where at in the process you stand - YOU have to contact them...

Others have had and documented same experiences as noted above.

If a “new used” vehicle was purchased and it came with a written warranty, the “lemon” aspect is a gray area.

Lemon Laws offered by the States usually afford more protection and greater chance of positive resolution on new vehicle sales for new vehicle owners than used car purchases.

However, if there was an express written warranty on a used vehicle and the owner is experiencing issues, then the owner may be protected under the Federal Lemon Law (commonly known as the Magnuson-Moss Warranty Act).

Some States do have Lemon Laws regarding used vehicles that are purchased from Registered Dealerships, but again those laws are totally different from the protections offered to new car owners. You would still need to review your State Lemon Laws or the Laws usually found or provided for under your State Attorney Generals Office or Consumer Protection Agency.

Even though there might be some relief for a used car owner under such above laws, it’s not a clear cut process, it’s much more involved; more than likely the owner will have to invest money for an Attorney and endure a much more prolonged process with no guarantee of coming out on top.

There are no used car Lemon Laws that protect vehicle owners if the vehicle was purchased via private party sales (ie: person to person). The best advice in this instance is be sure to thoroughly research the vehicle, see it in person, drive it or take it to a mechanic to review and know what it is you are buying. If satisfied with the vehicle get a written sales receipt from the owner. On that document list the VIN make/model/year and date of sale. Have the owner state conditions of the sale (if applicable) or any items that may be of concern to you. BOTH the Buyer and Seller sign the document and each gets a copy. That signed document may afford protection to the Buyer in Small Claims Court IF the seller were to have done something fraudulent in the way of repairs or was not honest about the condition of the vehicle.
