The ticket just says driving too fast for the conditions. He wrote out in the comments that I was going 70.
Submit that to a ticket clinic so they can fight and win this for you so you dont get points added to your license.

if its totaled now might be a pretty good time for it to happen because you'll probably get top dollar from the insurance company. if they don't give you exactly what its worth or more hold their feet to the fire. if you do it right they will pay out what you deserve.

hopefully it doesn't come to that but if you need any protips im happy to share.
It's been my experience that the insurance company will always offer you less than you deserve.
It's just Incase you're stupid, they don't want to miss out on taking advantage of you.
Do your research and find out exactly what your car is worth, then add on all aftermarket parts, tires wheels, suspension parts, etc..
Hold out for that figure and they will come around.
BTW, you're living my worst nightmare.

I was going 70 in a 65, so I also received a ticket. If the declare a total, then I can't get my stuff from the car? Do I need to contact the towing company and get over there as soon as I can?
Unbelievable that the pricks gave you a ticket for going 5 over. Adding insult to injury.
5 over is my normal cruising speed.
Unbelievable.
Where do you live so I'll know to avoid that area?

I have already did the research on cars like mine with with similar features and mileage so I have an idea of price. I have approximately another $5000 in mod like Shelby CS3 wheels, and Steeda Proactive shocks and struts that pains me to just give up. Bringing the car back here is really not an option as the HOA would go ballistic. Coyote2121, I see your car is the lighter green. I really like that color also, looks good from what I can see in your picture.

They fight the ticket for you so you dont have to, they will make sure you dont get any point or have to do traffic school. My brother in law is a ticket magnet, he gets about 3 to 4 tickets a year and so far they have won every single one for him.

Well considering he could have hit/injured/killed someone else when he crashed, I don't have a whole lot of sympathy... Not everyone does 70 in a 65 in what appeared to be a pretty heavy downpour especially in a fairly powerful RWD car.

Not trying to crucify the OP, but things more or less turned out "best case scenario" here as far as things could have gone (other than of course not crashing)
Same mentality as the asshole cop. Nice.
I know people like this exist, but I'm still always surprised by the realization.

Well at least you were able to walk away and were not seriously injured, take that as a positive.

As far as any aftermarket parts added - you're in for a battler with that aspect. Unless your Insurance Policy had a rider or provisions for added aftermarket equipment coverage OR if it was a total. Agreed Value Policy, you're not going to get any additional money for those parts.

The only way you can try to recoup the money for the aftermarket parts is supply receipts or even current online pricing of the parts and see if they will factor that in to your payout.

Without an Agreed Value Policy or a rider to cover said parts - the Insurance Company is only to cut a check for ACV, that's it. They base it on the vehicle "As Built" via the VIN and any option packages from the factory.

Future recommendation to anyone dumping $$$ into their S550:
1) Get an Agreed Value Policy. This means you and the Insurance Company agree on the value of the vehicle with or without add-ons. This value is documented/printed on your Policy Declaration pages. In the event of a total loss claim, the owner is paid the Agreed Value - no less and no more AND there's no haggling over "blue book" etc.

2) If you defer from an Agreed Value policy, ask your current Insurance Company what they offer (a rider) that will cover all aftermarket add-ons and what is needed from you for proof of value.

Bummer man. Next time, don't get Nittos. As mentioned they really are shit in the rain. Cheap tires which have a much better word of mouth reputation with people who don't actually try a lot of the current good tires. Nitto's street tires are older designs which really aren't up to speed with the current tire technology that other manufacturers are using.
WTF is this BS? ANY brand tire sitting at 30%or less of tread remaining are susceptible to hydroplaning in heavy rain/standing water. Nitto DR's have gotten me home NUMEROUS times in heavy rain when I slowed down and took my time to get where I was going.

He was an ABSOLUTE dick. What an asshole.
Not to cause issues, but when someone admits to an offense in front of an officer of the law, who may have a body cam that may be connected either in real-time 4G or for review, you’ve basically tied their hands to some extent.
I’m not saying that discretion couldn’t be used, but I am saying in 2022 there are more eyes out than just a short time ago and I could see where a sup. could ream an officer for not issuing on an admitted offense. Ideally, you just never want to offer any incriminating information when speaking to law enforcement. Period. When people are stressed or drunk they sometimes talk too much. It’s normal. Also, that little black box in our cars knows more than we want and I’m sure if you read the fine print of insurance polices I’m sure they can access it.

I’m sorry, did I spill some truth on your favorite brand?

tread design, tire compound, and tire construction all matter for how easily a tire will hydroplane and grip in the wet.
