This can happen. It will be up to the guy to fight his insurance company for them to bridge the gap and depending on the warnings before the laps they may have to bridge the gap and cover him. It happend once with me. Years ago my wife thought I paid it and I thought she paid it and we recieve a offical cancelation. I picked up the phone and talked to them and got them to bridge the gap for ten days. And found out later from a friend in the industry that a 10 day grace is actually required.So I just spoke with his insurance company, Geico, and they confirmed to me that his insurance policy lapsed on Nov 17th, just 3 days before the accident. Then the policy was renewed after the accident at some point. Seems a bit suspicious, no?

But in GA, the insurance company notifies the state of the lapse and you lose your registration and license. It then becomes a gross misdemeanor to drive.Sadly its the people who take take and take that seem to be the ones who do this kind of crap. My uninsured motorist coverage is at the Maximum because of this. You would be shocked at how many people drive around with ZERO insurance. And to put things into perspective in Va Beach the fine is a whopping $10 plus court cost ofcourse if convicted of driving without insurance.
This not correct. I was able to claim diminished value on my own insurance after i was hit by an uninsured motorist.You can only recover diminished value from a 3rd party responsible for the damage. Your contract with your insurance company (policy) doesn't cover it. But you don't have any contract with whoever hits you. Since they don't have insurance, you can still sue them for it IF they have two nickels to rub together.
Fight like hell to make your insurer total it. The fact they put it in writing that it was a total loss when they didn't know they were on the hook should go a long way.

When I lived in Illinois the DMV would send you paperwork you had to fill out that you had insurance with policy numbers and such. A no reply was a suspended license. I haven't lived there in awhile but that was what they did. They don't do that in Cali.Yes. If DMV catches wind its a $500 fine. RARELY happens and worse case license is suspended. Like that suspension matters, people do what they want, consequences for bad actions is becoming a thing of the past.
