Hi Mike,Hi Tom. I agree with everything you said with the exception of hiring a lawyer. If you have a MAJOR offense, yes, get a lawyer. For minor offenses, lawyers can actually hurt you in my opinion. Many judges will not take well to bringing a lawyer in for a minor offense. It is your absolute right but the goal is not to show up the judge but to get the offense reduced or dismissed. Unless you have an open and shut case, I'd avoid a lawyer but that is just my opinion.
A long time ago, I got a withhold. I was lucky because I didn't know the system. I fumbled around not knowing what I was doing and luckily, it turned out ok. The circumstance around that stop was I was doing 75 in a 70. A state trooper pulled up along side of me and was clocking me with his speedometer. So I got pulled over and given a ticket for 80 in a 70, yes, BS. Cops don't lie, right?
Anyway, fast forward to my day in court...... I watched a lawyer represent about a dozen or so clients all in one standing and he methodically went down any loophole such as logs, training, etc and when everything checked out good, he asked for a withhold. Unless the driver had a crappy record, the withhold was granted. I can't speak for other states, but as long as your record is clean, you can easily get a withhold and just pay the fine with no points.
So back to the lawyer..... The judge and lawyer were just two people working together conducting business. First the lawyer would try to get a dismissal for a technicality, and then wound up getting a withhold for his client as long as the officer didn't object. Someone in this thread mentioned that this is just a fundraiser. I agree. Unless you piss the cop off, or have a bad driving record, or do something really bad, the judge is fine with giving a withhold of adjudication.
I guess what I am trying to say is that its just business and my observations that day were that if I were to do it again, I would hire a lawyer who knew what he was doing. They don't cost a lot for a simple ticket and a lot have a guarantee or your money back.
