Look for local security or traffic cams in the area of the incident. Request copies of footage.
I'm not sure how else any fault would be determined other than he/she/they said from either party.
The validation of proof would have to be that the vehicle that was initially hit didn't leave their lane of travel at all.

No, I was in the eastbound lane. He was in the suicide lane.
