Just answered my own question. Apparently NV just does the OBD II check so all it has to do is have no check engine lights. That should be easy.

meaning I can't have the sensor turned off in the tune but still, a good tuner should be able to ensure the car never has a CE light.

Correct. They have to reprogram the rear sensors into thinking they're seeing what they want to see.
