Sounds like the wastegate spring is not working properly. Add some pre load see if the PSI where it fails rises. I'm no turbo expert but this is the reason big power turbo guys use compressed air as a waste gate spring
I have added quite a bit of preload already, I’ll add more in the morning and let you know if anything changes. I also have an aftermarket 19psi waste gate I put on prior to the install. but when I had it on, there was a whine coming from the engine bay almost like a super charger whine. Could this whole issue be tune related ?

Yes, it could very well be tune related, how may revisions did Ryan perform to get it dialed in for your car's setup and mods.

The tune I got came with the NX2 kit from FFP since it was cheaper to get it as a package and it’s a one time tune (no revisions). I’ll have to get another tune one that I can get revisions on from Ryan, but that would have to wait till the end of the week. The 19psi WG I have on standby is not included on this tune that I currently have.

FFP is just a middle man that IMO likely just get a basic one tune fits all NX2s from Ryan that's much like an OTS tune found on the Cobb AP. Every car/engine/mods are going to create the need for a slightly different individualized tune to tweak out the bugs and get the best performance from the tune. There is no one size fits all in this instance or one and done tune, it would need a few revisions to fine tune. I would contact FFP and talk to them about the issues you are having and see what they may help with.

Ah sorry I should have been more clear, it is still a custom tune tailored to my specific car, it’s just cheaper since I can’t get any revisions. I told Ryan what was on my car/what mods are installed and he sent over the tune, I just didn’t have to pay anything since it was covered by my FFP purchase. Sorry about that 😅

Ok but it's not performing correctly now so I think it needs some fine tuning IMO. I would see if you can at least send some logs for him to look over and see if there is something he missed.

I am confused what "on standby" means when you posted that the 19psi wastegate installed per your first post... is it installed or not?

I have a NX2 turbo that Ryan built a 93 octane tune for through several revisions and is currently building a 100 octane tune for me. He is a very good tuner and knows what he is doing. The NX2 comes stock with a 10lb waste gate and I specifically asked him if it needed more. He told me the stock wastegate was fine. I am no turbo expert but a 19lb wastegate is way outside of what NX2 deemed works for their turbo and what Ryan told me was needed. If you have it installed, I wonder what would happen if, just for funzies and curiosity's sake, you put back on the wastegate that came with the turbo to see if that fixes this for you... ESPECIALLY if it "is not included on this tune that I currently have".

The 19 psi wastegate *was* installed but it created a whine which didn’t sound good for the turbo so I uninstalled it then re-installed the original waste gate that came with the NX2 and the whine went away. The waste gate that came with the NX2 is the one that is currently installed. The boost problem is the same with both wastegates however.

this may be off topic but I noticed I'm getting compressor surge. as I accelerate hard I start to hear the turbo do its "stututu" sound while still accelerating, is me adding a good amount of preload on the waste gate causing that ?.

My guess is the gate or valve is opening then closing instead opening a small amount and holding.

My understanding is it should open just enough to bleed off the extra amount of air, or pressure. Not open and close.

So still think you have waste gate problems. It should be warranty able?
At least it is not bleeding off all the boost anymore. :)

He bought through FFP, they don't have a great reputation around these parts. Hopefully any warranty work is direct to manufacturer.

Wastegate preload should be about 2mm from zero preload position. Too much preload can cause damage to turbo impeller from the hammering effect of over boosting.

Have you talked to tuner yet about the loss of boost issue?
