This is textbook reckless driving... why would you post this on the internet?

I don't really see how his driving was reckless at all in the footage provided. He accelerated to block me out but his efforts were futile. Guess I should have pulled off to the side of the road to call the cops because he was tailgating me for over 5 minutes on the highway.

Again, I'm not trying to admit my driving here was correct, it was not. However, this was a close-call in the close-call thread. It pertained to the topic. I did not realize everyone here follows the law 100% of the time, goes to church on every Sunday, and donates to the needy.

I really wish people would just watch the video for what it is and stop trying to play the voice of reason. Nobody is perfect.

Again, you are stating the obvious. This is a close-call video in the close-call thread. Regardless of who caused the close call is irrelevant in my eyes. However no one likes to post a video like this because of the banter that will follow.

Should have just let him go at time 0:10 and be done with it. Who the hell is honking at the end of the video? If it's Mr. Lexus I'm sure the road games probably weren't quite over yet.

If that black car had to brake for some reason, you would have caused a rear end accident and your nice car would be junk and the other driver whiplash or clipped, pushed into a curb and potentially rolled. Best to find another way to discourage a tailgater.

Your maneuver could easily have caused a several car accident.

Be careful man, its not just your life and property involved.

You are probably posting a video of you engaging in reckless driving.

No law that says you can't take your dashcam off the windshield when ever you want and erase the memory card. It's your dashcam.
This is incorrect. If the footage is deemed materially relevant, there are numerous consequences to spoliation of evidence. Curative measures may be imposed by the court.

Destroying the footage could well be a violation of FRCP 37(e), and is certainly an "intent to deprive". In such a case, the Court may instruct a jury to presume the information was unfavorable to the offending party, and can even enter a default judgment as a result.

Dashcams can act as a double edged sword.

Meh, I didn't think it was that bad. Just a little mid speed tom foolery. Even if you crashed nobody would have been killed just some bruised egos.

Now in 2001 when I had my C5 we played some serious triple digit grab ass that would have spilt some blood. Thankfully I got out of that phase of my life unscathed.

If the court wants to try and prove something incriminating was on the video, they can go for it, but it would be pretty hard to "assume" something incriminating was on the video just because one doesn't exist. Maybe the dashcam wasn't in the car, or wasn't on, or looped over the video that was in question. A good lawyer is not going to let that happen in America ... well, at least not yet.

There is some internet postings asking whether a dash cam is an asset or liability. What happens in an accident, a police officer shows up, sees the dash cam, and then asks for the dash cam?

If its evidence then ya I imagine they could collect the footage regardless if you wanted them too or not...they have that right. Not a problem if your a witness or the victim but if your at fault it could be very painful in court.
