Hey everyone it's been a while since I've posted, I wanted to wait until lemon process was completed. I still have possession of the mustang however all buyback figures are finalized. I'm waiting till my new vehicle (4Runner for the wife) is delivered to dealer before surrendering my mustang.

Again I want to commend the BBB, they are professional, attentive and informative for folks like myself who haven't gone through this process. I kept all my service records and provided them with the requested paperwork. The BBB stayed on top of my case, everytime a deadline on Ford's end got close I was contacted and informed on the next steps of the process. Ford didn't respond to my request for buyback (2 weeks process) until arbitration was scheduled. Once arbitration was scheduled Ford sent a buyback offer within a few hours. Once Ford agreed it was sent to Ford RAV department. This department actually handles the buyback/replacement.

The timeline for this process has been excessive or atleast it feels that way. I filed with BBB March 9th and got the buyback figures from Ford April 8th. This is actually quicker than BBB goal of 40 days. I think what makes it feel so much longer is the fact I didn't have my car for 30+ days before I filed with BBB.

Do you mind me asking - what value did they give for buyback - and was there any fees/useage deducted from that amount?

It's defined in the BBB auto line definitions each state varies so check yours. The guidelines seem to be exactly the same as actual state lemon law. Only difference I found was replacement vehicle has no mileage fee in Alabama.

Buyback is:

MSRP
(-) any rebates
(+) tax,tag,title,intrest on loan
(-) mileage fee (which is based off MSRP basically ended up being .36 a mile)

Replacement is:

MSRP exchange
(-) mileage fee (same calculation based off msrp, however they will allow you to use first mileage of issue)

I planned to go the replacement route and get an explorer until I learned they don't allow you to use any rebates off on your replacement. I've read they will negotiate once you pick a replacement, I wasn't going to give Ford that opportunity. I doubt they would have given me 4,500 in rebates that were currently offering on explorer. Good business sense would be jumping at anyone who was willing to purchase another Ford after having to lemon their current Ford product. I felt like an inconvience through this process, Ford had no sympathy toward the situation their faulty product put me into. I would have been willing to let them take the measly $500 rebate they paid me on mustang out of the equation if they would give me the current rebates on explorer.
