I've been there before with multiple rear endings over the years. I tried not lawyering up but ended up almost getting screwed. The next time I lawyered up and was very happy with the and they gave me better than BB. I would locate a lawyer as most offer free call to discuss and get detail more info that you may not be aware. Stay on top of the insurance to make sure they don't use salvage parts or non-manufacture parts. Keep us posted!

I agree that the best course of action is file with you insurance company and let them duke it out with the other guy. You'll get you car fixed much faster that way. Of course it will not be the way it was before getting rear ended. Now having said that, don't be surprised when you insurance premiums go up next renewal even though it was not your fault. They always find some technicality to put some blame on you so that both insurance companies share the cost.

I would call again and say that you want to get this resolved and have complied with every request for information to-date. Then I would state that if they continue to drag their feet or not even respond, they will hear from your lawyer. Usually the mention of lawyer gets them to move in some form or fashion.
Why wouldn't you want Hagerty to subrogate the claim for you. My experience with my insurance company on a similar issue provided great results. Hagerty is capable of getting you results with the other party's insurance company and has lawyers to cut to the chase.

When this happened to me the next time I spoke to the adjuster I mentioned I was thinking about filing a "diminished value" claim on top of what they owed me for damages. Suddenly I had a check in the mail and they closed the claim.

Unable to offer advice but I think this is the best line I have seen in a while and a philosophy I regularly follow..."Since every problem calls for a spreadsheet"

Good luck getting resolved. Insurance companies are more slippery than an eel covered in lube sliding down a slippy-slide in my experience.
I also have no constructive input but would like to mention the Big Bang Theory Sheldon vibe the spreadsheet gave me.

I had similar problems with a company truck but it turned out the guy was getting divorced and was just slow replying back to his insurance. I can't fault him. I understand priorities.

I had an accident in LA and ran into the same slow-walk tactics you’re describing. Calls ignored, info requested multiple times, nothing moving. It quickly stopped feeling like a paperwork issue and started feeling intentional. Weeks passed with zero real progress.

After getting nowhere handling it solo, outside pressure was the only thing that helped. A brief consult and follow-up through Gammill Law was enough to change the tone. Communication picked up, deadlines mattered again, and the claim finally moved forward.

Good info. It seems the mention of the state insurance board got them moving and I got my money. Unfortunately, it's now a question of dealing with body shops. It's been an experience.
