Just got an email from dealer refunding my deposit on R Model after 6 months!

I placed an order for an R Model the first week the order banks were open. I have a signed sales contract and the dealer took my $2K deposit on 6-1-2015 assuring me they had an allocation for an R Model.
I passed on the opportunity to place orders with 2 other dealers that called me back after placing the first order.

The order info is:
Order # 0529, Dealer # F23261

The last update from was:
As of the August 12th update:
In Order Processing - Unscheduled- Material Hold

I just got this email from the dealer a few minutes ago:
"Our representative for Ford just told us they will not give us and allocation for and R even though we paid and have deposit sorry. We will refund your deposit."

UNBELIEVABLE - Can anyone help me??

Wonder if a big wig in the network of dealers decided to swipe it...The allocations were allocated in stone in April. Period, end of story. Either you had one (or many) or you didn't.

Unfortunately, it sounds like your dealer never had an allocation for an R in the first place. Like some other dealers, he may have assumed he could order whatever model he wanted just by paying the fee to join the Shelby program. Unfortunately, you're probably out of luck with this dealer. You can scream and jump up and down and threaten to sue him, but you'll be better off spending your energy trying to find an available R from another dealer, which, frankly, is not going to be easy.

I thought the allocations were set for the 2015 and 2016 MY's a long time ago...

Sounds like they either were banking on getting another R allocation, or the GM/DM decided they wanted the car and took it.

What state was the order placed in. ie your state and the dealer state.

You could file a lawsuit to get the records. If he did not have an R allocation you have a good case, if he took more R order than he had you have a good case, if Ford pulled his allocation you have no case.

If you have a case then you need to prove damages. Any additional cost to get a R now over your contract amount would be a good start

Good luck, The dealer is hoping you just go away, its up to you

How many GT350s did this dealer receive?

That's just shitty, no way around it. If I were you that dealer needs to make this right. In other words they need to track you down an allocation - and should match your deal. You may be out an R, but at least a Track Pack GT350 at MSRP would be a nice gesture.

Forget the lawsuit - you'll spend more time and money chasing this than you'd ever pay in ADM at another dealer.

My thoughts as well. This is why I specifically sought out a large dealership and was willing to pay a reasonable ADM to get an R. My condolences to the OP, maybe next year.

Guys, I was repeatedly reassured by this dealer that they had 1 non-R and 1 R model allocation. I confirmed as best I could till I was blue in the face that they had an R allocation. In the last 6 months since the order was placed I sold 3 of my vintage Mustangs including 2 K Code HiPo cars. They would NOT have been for sale except to be able to afford to pay cash for this car. I am devastated.

The only way that could have been true is if their R allocation was won via the lottery.

I can certainly appreciate your position and level of frustration. I know it's a long shot, but I would, at the least, call Ford Performance and plea my case.

It may not net you an R, but it may help sort things out and bring closure. Also, if somebody has been playing games the call may shed some light.

Just a thought.

I think the sale of your cars in preparation for the R order and the understandable feelings you're left with after this shocking news, is plenty to prove damages against this dealership who misled you. Did you know that in most small claim court districts you can sue to force an action instead of or in addition to money damages? It might be worth forcing the dealer to explain their incompetency to a judge since they clearly never did the due diligence to ensure they had the R available. But they had no problem taking your money and stopping your search for a car. It's possible they could be legally forced to find you the R model they sold you, if a judge understood how serious this is.
