You're taking a gamble with those aftermarket tunes vs. your warranty. Ford could detect a tune was installed previously and deny based on something.

If you want to take that same gamble, just tune it with the PowerPack yourself (not registering it) and try to remove the tune if you have a problem, and have them prove that the "mystery tune" that was there before caused the problem.
This is a guess, but even if it's not registered I'm thinking ford would be able to detect the previous tune was from their own engineering.

Regardless..would a person with a transmission problem at 40k miles have rather had an aftermarket tune that wasn't related to the problem (or at least got the opportunity to have it proven that it was), or would they want the FRPP tune and already be out of warranty when the transmission died, whether the tune was at fault or not?

Personally, there isn't really anything that would make me consider contractually ditching 30k miles and two years off my factory warranty.

**As I understand it based on a thread in the engine section of the forum containing correspondence from Ford**

The power packs from FRPP drop your warranty mileage to 3 years and 36k. Not 36 from where you area, but UNTIL 36k miles. So if you had 1k miles and got the pack, you now have a 36k mile warranty instead of 60k (or whatever the new is). If you get the FRPP pack and have 35,999 miles on the car, you now have 1 mile left on your warranty for the entire vehicle, powertrain and all.

Absolutely and completely not worth it when you can mod it with another company and not necessarily void it, depending on what actually goes wrong with the vehicle and if the tune/mods did or didn't contribute to that failure.

Sounds like the warranty is same as any other aftermarket part, except they won't even consider the tune a problem for the first 36k miles ?

Personally, I think the FRPP is the safest bet.

1. They know the engines, transmission, cams, timings, specs, better than anyone else. So IF they leave a little performance on the table its there for a reason!! ie: lower risk of failure / better long term reliability.

2. If you're up front and have the tune installed by a dealer, they're probably going to cover you for whatever if you only have Ford Racing parts on the car.

3. If you go to sell your car, and you have Ford parts people, IN MY OPINION, seem to not mind as much as other aftermarket parts.

My point has never been whether FRPP is the safe bet. My point is, he loses his powertrain warranty beyond the 36k mile mark if he goes with #2 Car #2 only has 20k of warranty remaining (and whatver time period is left of the three years from the day it waas purchased) right now at this very moment while car #1 has 50k remaining (and the remainder of five years). If he was to go with car #2, regardless of what goes wrong and whether the tune caused it or not, he loses the opportunity to have his powertrain diagnosed and repaired after the car has 36k on it.

And although your thought process about them taking it easy on you if you had dealer installed ford upgrades is somewhat logical from an emotional and humanitarian aspect, that just isn't the case. It doesn't matter if ford engineered it to leave some power in the tank for their tunes. Out of warranty is out of warranty. If he rolls in there at 40k miles with a busted transmission that had nothing to do with the ford mods, he's still SOL. Not covered. Ford pays the dealer back for warranty work. Ford isn't in the business of giving people breaks on their warranty just like a reputable dealer isn't likely to give you a break and take the risk cheating ford by not disclosing the upgrades and their effect on the warranty.

I wouldn't even bother going into this much back and forth about this with a stranger via the Internet, but if the guy is making a decision between the two cars he needs to know the facts.

The last gen ford power packs caused pinging, or detonation, and had some problems. The new ones have been giving a few people problems as well. I wouldn't go with ford tunes to be honest. The aftermarket ones are generally better.
