I was caught doing 62 in a 50MPH AV speed check on the M1 near Leeds a week or so ago. I usually am very cautious of these, so clearly it was a lapse in concentration and in 30 years it's the third ticket. The last one was a year ago where I did a speed course, so still zero points.
Typically it's now the new laws have come in but some web sites / experts say penalties have risen for court appearances and others say penalties have risen based on earnings no matter what the speed.

I am not bothered about getting off it, let's just assume it was my fault and it was an error.
What's the betting, do I get a £100 Fixed penalty owing to history or is it automatically the case I get 50% of my weekly income - without going in to too many details the difference would be a rather a few times more than the £100 , it would really sting. Not sure how they would know my income unless I had to fill out a means form. If we all had to do that for speeding fines it would bring the system to a grinding halt
Interested in the thoughts and views, I will of course update with whatever the fine is !!

Let's avoid rants at me being a danger on the road or how to get off the fine, I just want to know people's thoughts as what might be coming my way !!

Would be interested to know "How" they determine your salary? Is it raw pay? Pay before tax? pay post tax? Total salary / 52? What if you're a contractor and paid by the day is it day * 5? What if you work 6 days/7 days a week etc.

Many differentials it'd be kind of curious to work out, more on my side on the contracting element as a colleague just got caught 2 days ago, and he knows he went through it too fast, he's just waiting for the letter, but, his day rate * 5 isn't always correct, nor would be working out total working days (less BH's) * day rate... As our contractors at work don't get paid for their Holiday/Annual Leave/Bank Hollidays etc.

Interesting discussion points to behad :p

Looks like it falls in the Band A fine (51 - 65mph in a 50mph) so 50% of weekly income and 3 points...... They seem to band it now, Band A - 50%, B - 100%, C 150%.....

However how does this work against 'disposable income'?? This is purely a tax on the working..... :crazy:

Blimey! some weeks I earn nothing then on the rare occasion I can pull in a month or more's money.

Must remember to only speed on my skint weeks.

According to review sites they indicate gross wages.... I just wondered if the Fixed Pen notice comes through these days?

Without trying to state how much I earn, this fine would go from £100 to 8 times more !

The minimum penalty for speeding is a £100 fine and 3 penalty points added to your licence.
If you’re stopped by the police for the speeding offence, they can either:
  • send you the details of the penalty
  • send the case straight to court
If you weren’t stopped by the police for the speeding offence (eg it was caught by speed camera), the vehicle’s registered keeper must be sent a notice of intended prosecution within 14 days. You may have to go to court if you ignore the notice.
The Association of Chief Police Officers (ACPO) issued revised speed enforcement policy guidance in 2013. It suggests that enforcement will normally occur when a driver exceeds the speed limit by a particular margin. The particular margin is normally 10 per cent over the speed limit plus 2 mph. The guidance sets guidelines for when it would be appropriate to issue a fixed penalty notice or for the driver to attend a speed awareness course, and when it becomes appropriate to issue a summons. These are guidelines only and a police officer has discretion to act outside of them providing he acts fairly, consistently and proportionately.
In summary the guidelines are:
Speed limit: 20 mph
ACPO threshold for:
a fixed penalty or a Speed Awareness course: 24 mph
summoning: 35 mph
Speed limit: 30 mph
ACPO threshold for:
a fixed penalty or a Speed Awareness course: 35 mph
summoning: 50 mph
Speed limit: 40 mph

It was 62 in a 50 which under new rules seems to be band A = 50% of weekly income. the above suggests that that speed of 62 would be a FPN but then when does band A ever become relevant?

As it reads the new FPN is the banding so Band A 50%... I guess there must be some process for declaring earnings??

At least it's limited to £2500 on the motorway (£1000 elsewhere). Probably not helpful.

As an analyst by trade, i'd love to see how they've done this... If they've got something that auto's your tax documents from the gov, piece of cake, if they've not... Then it's weeks and weeks and huge costs... Doubt it's make up for the larger value.

I expect the "fake police cameras" will be out asking for sh1tloads now, can just see it happening :headbonk:

National insurance numbers is how they do it they take your NI number (or simple to look it up from address and name) then that links to your hmrc paye or self assessment earnings or both and they know your tax code and what tax bracket its in so its pretty easy to establish your earnings to calculate it.
