Dealer ESP issue

HI I had traded my Mustang with a Flood Ford ESP....the dealer told me that the ESP was not transferable to the dealer. I went to cancel my ESP plan to get my pro-rated refund and I was told by Flood Ford that the ESP was transferred already, I never gave anyone permission to transfer the plan,. What to do?

It can't be transferred or cancelled without your written consent. Seems like a scam. Just read your contract and look at the section about transferring or cancelling. Nothing else anyone says on here will matter when it comes to contract law.

It can't be transferred or cancelled without your written consent. Seems like a scam. Just read your contract and look at the section about transferring or cancelling. Nothing else anyone says on here will matter when it comes to contract law.
Does that apply though when the owner has signed ALL docs transferring ownership of the vehicle to X, be it a dealer trade in or a private sale?

There has to be fine print somewhere or something in the docs signed that was missed.

As far as I know, once a vehicle is traded in at a dealership - all paperwork signed is transferring ownership and rights of that vehicle to the new party/owner.

Here is some information from the FloodFord website

I traded my car in to a dealer, which is not a private party, plus I never contacted FloodFord to do the transfer. When I was negotiating the deal, the ESP was brought up and the dealer said it was not transferrable to them. As this would have added to the trade in price, now when going to cancel the ESP to receive a prorated refund, I learned it was transferred. I never requested it to be transferred and I never paid any transfer fee.

Plus my understanding is that the ESP belongs to the original subscriber for that particular car. The ESP is not connected solely to the car, which would allow it to be transferred for each change in car ownership. THats my understanding

Is an ESP contract transferable if I sell my vehicle?
Yes
. For a $75 transfer fee you can transfer your contract to another person (private party) to give them the added confidence of Ford Protect. Coverage is transferable from private party to private party, through the life of the contract. The fee may vary by state.
