First, glad you are OK.

Second, you need to have a discussion with either your agent or your adjustor about coverages available to you under your policy. Most policies will not allow diminished value under Collision coverage if the vehicle is repairable. However, if you have Uninsured Motorist coverage for property damage, it may give diminished value back. You're also going to want to know what, if any, type of medical coverage you have on your policy that would be applicable. Some carriers also offer Uninsured Motorist coverage for your injury claim so check to see if you carry such coverage.

As for being a total loss, most states set out a formula or certain percentage of value cost of repairs are which the insurance company must follow when determining if your vehicle is a total loss. They may have some leeway if it's borderline.

And for all those telling this guy to go immediately get an attorney, hold your horses (no pun intended)! You do realize he just told you that it was a "kid", DUI, with a prior record, and no insurance, right? Do you really think there is going to be anything for that attorney to go after, other than a third or 1/2 of whatever settlement he gets from his own insurance carrier?

Do your research on the value of your car in case they do total it so you know what is a fair offer. If your carrier wants to repair the vehicle, insist that the shop YOU select completes a tear down of the entire car before they order parts or begin repairs so any hidden damages may be discovered. Many times a vehicle that is not a total loss upon initial inspection may indeed become a total loss once a tear down is done and all damages are known.

Good luck and hope it all works out!

Glad your okay, soft tissue injuries will heal in time. Sucks about the car just remember these things can take time to be handled right don't be in a hurry. Hard to tell if totalled based on the photos I would think the dog needs to hit 22-25k to be a total.

Best of luck with this.

I dont know you but have been hit a few times by idiots throughout the last couple of years. First off i would have this thread deleted until after you settle with the insurance company because they can use anything on here against you. Number 2 go see your primary care physician and let them do a head to toe exam of you. Number 3 the insurance agent is not your friend and dont be fooled. Last but not least i have had cars hurt worse than that and not totaled (13000$ damage on a 22000$ Mustang 6 months old). I have had 3 vehicles get hit more than once and got a good trade in on them because the work was done right

Even though it looks ugly, that's a relatively light hit in the collision business and that's why the bags didn't go off. If you don't know of one already, ask around for a high quality body shop to go to, and more times then not, going back to the Ford dealer isn't necessarily the best answer as all dealer body shops are different in terms of quality.

If totalled - a new leftover '16 GT would be your best bet. Good luck getting a GT350 for under $65k with the greedy dealers.

No one is going to total a 10 year old mustang for $1300 in damage, let alone a 6 month old one. A repair bill that small usually won't even affect resale value

I have uninsured motorist coverage, and I personally will not be attempting to sue this kid. I also do not understand why I would delete this thread. I am not seeking anything unfair nor have I said anything here I haven't already told the insurance agency. I posted this here solely for opinions and advice.

Again, thank you everyone for your input and advice. I'll let you know how it turns out. It would really suck to have to have a car that barely has 3,000 miles on it have extensive repair work, and possibly even more of a depreciated value. Whatever happens happens, I'm just glad to be alive:ford: and I'm sure the insurance company will be fair.

My mistake it was $13000. I miscounted my zeros and i traded the car in and broke even on it even after that

Insurance and fair? Wait until they tell you how they are going to repair your 3000 mile car with parts that are non oem or used takeoffs from their salvage yard. I speak from experience

You hit it right on the head. I had someone slam into the back end of my 2006 after it was only a couple of months old and the insurance company wanted to put a used bumper on saying the car was used. I had to fight tooth and nail to get new parts. Insurance companies will screw you over if you let them.

It was suggested there may be some interest in pursuing counsel. OP, if you choose to go that route I would encourage you to cease posting about this until the legal process has completed. Something to consider.
