Excuse my ignorance but is it even legal for people this mentally ill to have a license? If we're going to rely on this defense that he's so mentally ill that he's rambling insults uncontrollably then why is he driving customers cars?
In most cases yes, because it would not be "PC" to "discriminate" in this era. Same reason we still have no re-testing for elderly people who some have no business behind a wheel still but you can't do anything because mail your check every 4-5 years and it's renewed. It's not "PC" sadly.

It is perfectly lawful to record anyone while in or on the property of another owner (owner recording). Same as putting a camera on your property or inside your home. These get used for prosecution everyday.

I still wouldn't want the guy working for me, but I get the defense that he is just mouthing off. However recording is 100% legal in all states, the car is considered private property, LE would have a field day with this if the car was stolen.

As far as firing the guy, the thing is most companies have you sign paperwork these days and most people dont read it, most have clauses saying disparaging acts or comments about the company are grounds for dismissal. I know this for a fact because I have seen it many times.

The days of instant internet fame is here and a simple video like that can ruin business opportunities regardless if they appear harmful or not.

Just imagine the most miserable person you have ever met in your whole life working as a parking attendant. As he is moving your car to the car wash he's using profanity calling your vehicle "junk on a stick" repeatedly all caught on a dash cam. He also makes a few snide remarks about the owner. That was basically the video.

In regards to the legality issue, it's tough because every state has different laws. From what research I've been able to do, it seem as though recording video is fine because it's a dash cam. Recording audio is where it gets tricky but it seems that regardless of the state, it's generally illegal to record a conversation you are not a part of.

You could argue that a car is private or public (again, depends on the state) but I think you're just better off turning off the audio and saving yourself the headache of possibly getting sued. Besides, I think it's more important what they do to the car rather than what they say about it. I actually have a dealer appointment coming up soon for a TSB so I'll be turning off my audio recording.

I'm not a lawyer though so if you really wanna record audio, it'd be smart to talk to a lawyer first.
