I got a speeding ticket last Saturday. He claimed he clocked me at 80 in a 65 zone. I don't think that is right as I had my cruise set on 77 or 78. I know still too fast, but I was going with traffic and I had a guy creeping up on me so I sped up a bit. Stupid as I picked up the day at work and was messing with the nav looking for cheap gas as I was running on fumes and wasn't paying attention or I might have seen him parked in the median. In a year and a half I don't think I've ever seen one parked there before, but it was the holiday weekend.

Anyway, my last ticket was around Dec. of 15 so I now will have about 4 points and I don't want my insurance to go up. I did a lot of searching and its about 50/50 that insurance will go up. I have geico and it sounds like they are more concerned with accidents than minor speeding tickets. I don't want to take any chances so I think I'll at least go to court and plead my case and most likely plead no contest, but I will likely still get 2 points. I called the court and she said I can't take traffic class until I get at least 6 points. So my only other options are to try to find a reasonable priced lawyer and see what he can do or plead not guilty and take my chances. So what do you guys think?

See if you can get deferred. Iv'e done it about 4 times now. I'm on Geico as well.

Plead not guilty, send the money and when your court date comes up the day before contact them and tell them you will be out of town for work and change your plea to guilty. Sometimes they just keep the money and don't give the points and sometimes they do. Or get a mouthpiece.

Fight the ticket. Request a discovery package. In said package. Ask for the calibration certificate on the radar equipment used. It has to be calibrated yearly by an independent company. Police stations never do this. Because it would involve removing the equipment. Or the squad car from service. I've beat at least 10 speeding tickets like this over the years.

If you don't get many tickets I'd take the defensive driving option if it's available in your state. We get 1 class a year for a free dismissal.

I don't know about your local PDs because I don't speed in the city but out on the interstate I'll sometimes get popped by the state Troopers. They always serve court in the local county which is typically the cop and a local judge in a tin building. I've had zero luck fighting those tickets. They just laugh at you while they read you a guilty verdict and direct you to the cashier. Which occasionally is also the judge.

What does that mean? btw Fraz, I already checked about traffic school and they said you have to have a certain number of points and get a letter, which is 6 in Ohio I believe before you can take it.

Wow, now I know why Cincinnati Microwave and Valentine Inc are in Ohio.

Differed is short for differed adjudication which means if you don't get another ticket within a specified amount of time like 6 months or a year then the ticket will be dismissed. It's like probation but for traffic tickets. But you have to ask the judge for it and typically the judge will ask the PA (prosecuting attorney) if he consents. If you do get a ticket within that time the both the differed violation and the new violation go on your record together.

All of this is why I use a traffic attorney now.

Living in San Antonio i used differed a lot. Helps keep tickets off your record. The city likes it too because you still pay a fine.

You could ask for a PJC (prayer for judgement continued) possibly. I think its similar to asking for differed judgement. Not a lawyer though so it could be not applicable in your case. I've heard finding out if the radar calibration is valid is usually the best bet to get the ticket reduced or dropped all together but not fool proof. And I've only ever heard from anyone respectable to not count on the cop missing court. I mean that is his job for the day.

My speeding ticket experience was I was booked going 74 in a 45. Went to court in a suite they reduced it to 9 over and I agreed. Paid the fine and that was all. It didn't affect my insurance. That was me though. If you are super worried and have time you could request your driving record (which cost money here) to see how many points you have for sure. I believe in NC there is a difference between license points and insurance points. I am not fully aware how they get tracked/counted but I was in an accident 6 months ago (totaled my last car got a mustang :thumbsup:) and the result was 3 insurance points but I did not get any license points since the DA dropped the stupid ticket the officer gave me at the scene. I still got a solid bump on my premiums though from the insurance points.

Best to consult a lawyer if you are truly worried. Doesn't cost anything to make a phone call. Just might cost you if they answer the phone call ;)
