I had a dealer in Mass try this on a dealer order. EDD was within a week and it kept getting pushed out. I finally gave up and bought at another dealer. Once I spoke with the GM and he still wouldn't refund it I just initiated a charge back on the credit card. Laws vary by state but typically unless it is in writing that it isn't refundable it is.

Typically a business can only keep a deposit if they can prove an actual lose. With a car it is probably next to impossible since the car will sell and they will make money just a question of when.
Wow. So you got your money back in the end. I feel bad for the salesman I have dealt with but I'm looking at the end of January for my car to come in.
Thanks for the info. The dealer is in va so I have no idea of their laws.

Today I found the exact car I ordered at a local dealer, they are also willing to let me use the 750$ cash from ford and the 500$ rebate with Xplan.
Explain this $500 rebate please, the X Plan should save more than $500 on a $40K car. Or is above and beyond that? I plan to use X plan on my convertible

There is a new rebate out now and it's 500$. Sales mgr confirmed to me that it can be used with X plan so hats one smoking deal esp if you have a 750$ cash coupon from ford

Well I'm new here as far as posting but have been lurking around for a while.
I have a question about the deposit left on an order I made back in late October.
I put down 500$ with full intent on waiting for my car but it has taken much longer then I was told and I'm in need of a car ASAP.

Today I found the exact car I ordered at a local dealer, they are also willing to let me use the 750$ cash from ford and the 500$ rebate with Xplan. Another bonus to leaving the order I made is I will be able to use the 1250$ from ford which I would lose by the time my order comes in.
Is there any chance of getting my 500$ deposit back from first ford dealer if I cancel the order now?
Why don't you just call the dealer and ask? I'm sure you will find the best answer to your question.

Thanks. Yea like I said before if I would have known I was looking at 3+ months, expired rebates and car issues I would have given it more thought .

my dealer ordered mine 0 down, they know they will sell it no matter what. My 4th car from same salesman. Only base GT with PP on any dealers inventory with 250 miles. And nope mine want show up on inventory because it's an OT1

bottom line is they should return deposit.

They should be able to sell that in a week, avg. is 6 days on the lot for mustangs and GT cars aren't sitting but days.

In all seriousness, if they insist on keeping it - ask (politely) to speak to the sales manager and just tell him that you hope that they get a lot of use out of that $500, because it will be the last penny that they ever see from you. You will never buy a car or a part or a service there, and you will encourage your friends and family to do the same. Word of mouth advertising is the best advertising.

Thank him for his time and head for the door. If they still keep it, you should understand that you just got some really good value for your money - you found out what kind of dirtbags they are, for only 500 bucks. Sometimes we have to spend tens of thousands to learn that information.

I've got a paper that shows total price and 500$ deposit paid for special order, all written in the blank part

Can you describe this paper a little more? Does it have any fine print? And if it does, is there anything regarding the deposit or "liquidated damages"?

Also - during the ordering process and prior to you putting down the deposit, was there any discussion regarding the timeline? Did you indicate that you needed the car by a certain date and/or did they provide you with any assurances regarding its delivery date?

The form just says worksheet. Lots of fine print but mostly about financing the car. We spoke about delivery dates and he said over and over 6-8 weeks. I told him I've been seeing longer and he said it should be 6-8 weeks. Looks to be a basic form he used just to put numbers on for me.
I let him know I wanted the car before jan 2015
