Dealing with insurance after a wreck

My car is in the body shop after an accident that wasn’t my fault, and I’m having trouble with the other drivers insurance company. They have to replace one of my rims, the problem is they want to use a reconditioned one and I want a new one. They are the Performance pack rims. Any ideas on how to get them to replace it with a new one over a reconditioned one?

Reconditioned is still OEM. You probably aren't gonna win that battle unless the shop fights for you.

Unless vehicle is over 5 years old NEW OEM only. If they shop and insurance wont do that find another shop or legal route.

Heard far to many people get raped in a "not at fault" wreck.

And do not leave any .....any..... loss of value on the table.
That ding on carfax is worth minimum 10% of your car's value today. And bank it because you will be hit for it when sold or traded.

I was recently in the same boat. Unfortunately, it’s pretty standard and accepted for the insurance company to screw you like that. What really got me, the wheels on the car were obviously aftermarket to anyone that looks at cars for a living and I had to argue a bit. I even used a shop that was outside of the insurance company’s “recommended network,” or whatever they call it, and had no problem pushing back against them.

I eventually came out with full compensation for my aftermarket wheels, but I’m not sure how it would have turned out otherwise. They originally wanted to put a reconditioned taillight on as well, which is a huge gamble on an expensive part in my mind, and complete bullshit. I can’t find in my paperwork what I ended up with, but it is OEM.

I don't know what state you're in but here in Texas you can take your car to any body shop and the insurance adjuster can't say anything about It. I've had good luck with adjusters before. I had a GTO that got wrecked once and requested all GM parts and they gave in and did it.

most major insurance companies nowaday going to find whatever cheap parts to repair your vehicle, so you just going to have to accept it or pay out of your pocket for oem

You can get your insurance co to write the estimate. It will no go against your rating or premium Since the accident was not your fault. You can also get a third estimate on your own as well.... you wil have to be persistent with the other persons insurance co as well when it comes to diminished value especially if the damage was more than just cosmetic.

Also reconditioned doesn’t necessarily mean you will get a bad wheel. It’s actually one brought back to OEM standards or one salvaged. If you car is 2 years old then sometimes a reconditioned one will match your used ones A little better than a new one, specifically paint and color.

It’s a 2017 GT Premium PP, asshole in a Nissan Altima came across 2 lanes from his right lane to my left lane and hit my passenger side, at 75+MPH. Pushed me on the shoulder and almost into the guardrail. Caught it all in my dash cam.
I took it to my choice of body shop, but the adjuster is being a dick and threatening the shop if they can’t agree to terms he will have my car towed elsewhere. The shop is going to bat for new parts, and did get new bumper, door, and fender, but he’s balking on the rim. And he refuses to talk to my husband, after I’ve given him his number because I was working and unavailable, he continued to call and text me.
We are in Florida and have Progressive insurance but the other driver has Geico. This is the first accident I’ve been in since 1999, and things have gotten worse since then. The body shop said Geico is one of the worse insurances to deal with, as far as claims go.

Your insurance can get away with it since it’s generally written in the contract.

But since it’s not your insurance you can push back and get a new one. The car needs to in the exact condition before the wreck.
Also push for diminished value since it’s now on your carfax.
