Sounds like they don't want to have to deal with it. Plug it in show it works for 5 minutes and dismiss it as "working as designed". Lets hope that isn't the case but don't hold your breath.

For Darko above, thank you. There is no way the upper seat can cool it to 14 degrees below ambient. My back will be at 98.6 or thereabouts and even in 80 degree cabin air, a 66 degree cooled air...
I've said it before and I'll say it again. Follow the F150 contingent. They have 10 times our numbers, they pay up to $60K for a loaded out truck and they are VERY demonstrative. I'd be willing to bet dozens on that site have already registered complaints on that Federal Highway Safety site...
Individual dealerships won't be the ones who solve it. Ford Engineering will come up with the fix more than likely from looking at this thread or the one on the F150 site.

Don't be shocked that in a month if they replace your cushion and upper unit and it still doesn't cool properly. Just prepare yourself. Keep hopeful but don't be surprised when they replace it with the same old junk to start with. If and when a TSB comes out we will know if they are using...

Whatever "snorkel" Ford fits to the F150 unit should fit to ours. (And the Fusion as well I would think)
If this is the route Ford is taking we will probably see some marginal cooling but I don't see them even coming close to the bottom in cooling ability short of a total...
