Yes the law states they must prove the modification caused the failure. Usually takes a lawyer to battle this. You were lucky the BBB acted as the lawyer for you. Not every state BBB will.

Ford tune is not able to be modified for mods other than tire and gear changes

There are several threads on here, this can't be done with forscan. It can be done in a tune. The ford performance tune gives you the option.

Fixed the rev hang and allowed 4.09's made me real happy

Was worth it to me! Put it on when it came out and still happy with it. If you want to stay legal I recommend it.
