Could it be the fob battery?

I thought i would get mine replaces under warranty---but I was told no. A new fob is about $300

Scratches from the trunklid on the bumper can only be seen with the lid open. So it is not as bad as I had with a Maxima and saw on every 2000 Maxima. It is still annoying. The marks are on the lid too
