I live in maryland and they don't pull you over for tint unless they really want to pull you for something else, other than speeding. Law enforcement is not typically initiaing traffic stops due to tint violations anymore. Trust me :)

I would say it has to be the actuator. Even if the wires aren't visibly worn, there can be a short somewhere in the wire. Mine would go in and out. How many miles on the car?
