This is ridiculous! You should take it to another dealer immediately and if you get the same response then, contact ford customer service. If they can't help you then, contact a lemon law lawyer and provide the documentation. They can probably give you the best advice at that point.

I purchased my esp from Flood Ford and I have already used it several times and there's no difference. Some dealers just want to charge more to make more money from you. In fact, I called Ford before I purchased it and they told it's all the same warranty regardless of what dealership you use...

I wouldn't recommend doing any modifications to the car, especially a tune. You could void the warranty. Then Ford won't be responsible for fixing your car. I would strongly advise against it and advise you to continue to take your car into the dealer and report that the CEL has come back...
