They certainly can. Ford lost rights to sue for just about anything copyright related years ago when they let the aftermarket reproduce just about every iconic mustang ever made.

I would hope ford can't sue because then what would that say about the gt350 body kits or any other parts for that matter. As for the GTT body kit itself not sure how I really feel. Not sure if I love or hate it. Probably have to see one in person.
